RESPONSIBLE GAMING FUND [ S.L.583.01 SUBSIDIARY LEGISLATION 583.01 RESPONSIBLE GAMING FUND REGULATIONS * LEGAL NOTICE 12 of 2014. 1.

(1)The title of these regulations is the Responsible Gaming Fund Regulations. Citation and commencement.
(2)These regulations shall come into force on such date as the Minister may by notice in the Gazette appoint. 2. In these regulations unless the context otherwise requires - "the Act" means Gaming Act; Interpretation. Cap. 583 "the constitutive instrument" means the public deed which shall establish the Responsible Gaming Foundation and includes a reference to all those related attached documents which shall be delivered to, and filed with, the Registrar according to law; "the Foundation" means the Responsible Gaming Foundation; "the Fund" means the Responsible Gaming Fund; "the Minister" shall have the same meaning assigned to it by the Act; "the Registrar" means the Registrar for Legal Persons. 3.
(1)There shall be a fund to be known as "the Responsible Gaming Fund" which shall be composed of monies collected for the fulfilment of the objectives of the Foundation as defined in regulation 5. The Responsible Gaming Fund.
(2)The Responsible Gaming Fund shall be administered by and be under the general control of the Responsible Gaming Foundation. 4.
(1)There shall be a foundation to be known as "the Responsible Gaming Foundation" which shall be created by public deed in accordance with law to administer the Fund and fulfil the objectives defined in regulation 5. The Responsible Gaming Foundation.
(2)The Responsible Gaming Foundation shall be a purpose foundation and shall be regulated by: (
  1. a)the relevant provisions of the Second Schedule to the Civil Code which regulate purpose foundations; and (
  2. b)the constitutive instrument.
(3)(
  1. a)The administration and management of the Foundation shall be entrusted to a board of administrators which shall be appointed by the constitutive instrument. (
  2. b)The board of administrators shall be composed of the Chairman and four other members. *not yet in force. Cap. 16. 1 2 [ S.L.583.01 RESPONSIBLE GAMING FUND (
  3. c)The board of administrators shall appoint a board secretary as determined by the constitutive instrument.
(4)The legal and judicial representation of the Foundation shall be vested in the Chairman and one administrator acting jointly. Objectives. 5. The Responsible Gaming Foundation shall have the following objectives: (
  1. a)to administer and manage the Responsible Gaming Fund in accordance with the terms of the constitutive instrument; (
  2. b)to participate in the organisation of, to facilitate or assist the organisation of, and, or to organise projects and initiatives aimed at providing awareness on problem gambling, and, or conducting research initiatives on responsible gaming and problem gambling, and, or assisting in the rehabilitation of problem gamblers, including the offering of necessary support to families of problem gamblers; (
  3. c)to encourage activities alternative to gaming; (
  4. d)to foster further education into responsible gaming and problem gambling. Powers. 6. The Responsible Gaming Foundation shall have the following powers: (
  5. a)to register the foundation as a legal person in terms of law; (
  6. b)to utilise or pay out such percentage of monies belonging to the fund, which percentage shall not exceed ten per centum of the total Fund income, as may be determined by the board of administrators from time to time, for ordinary expenses incurred in the running and administration of the Foundation; (
  7. c)to collect, distribute, pay or apply the whole or such part of the Fund for the fulfilment of the objectives of the foundation; (
  8. d)to coordinate with organisations embarking on initiatives consistent with the objectives of the Foundation; (
  9. e)to apply for European Union funding with regard to projects related to responsible gaming, or gaming prevalence studies, or rehabilitation initiatives targeted at problem gamblers and their families, as well as any other projects consistent with the objectives of the Foundation; (
  10. f)to undergo or commission research into problem gaming; (
  11. g)to enter into collaborative agreements with other organisations which have a similar purpose to the Foundation, or the purpose of which is complementary RESPONSIBLE GAMING FUND [ S.L.583.01 to the purpose of the Foundation, as may be determined by the board of administrators; (
  12. h)to do all such acts as are considered conducive towards the attainment of the objectives of the Foundation. 3
