- requires: In these regulations, unless the context otherwise Interpretation. "Act" means the Psychotherapy Profession Act; Cap.
- "Appeals Committee", means the Committee established in accordance with regulation 3; "Board" means the Board of the Psychotherapy Profession in Malta established in accordance with article 4 of the Act; "Minister" means the Minister responsible for the psychotherapy profession. 3.
(1)There shall be established an Appeals Committee to be known as the Appeals Committee for the Psychotherapy Profession in Malta, which shall be composed as follows: (a) whom: two
(2)members appointed by the Minister of (i) one
(1)member shall be a warranted and practicing lawyer, who shall act as the Chairperson of the Appeals Committee; (ii) another
(1)member shall be a warranted psychotherapist; and (b) one
(1)member who shall be a warranted psychotheraptist in the modality denoted in the appellant’s application, appointed on an ad hoc basis by the Chairperson of the Appeals Committee.
(2)The two
(2)members of the Appeals Committee appointed by the Minister, shall be so appointed for a term of three
(3)years and may be re-appointed or re-elected for a further term of three
(3)years.
(3)The Minister shall appoint a person to act as Secretary to the Appeals Committee, who shall have the duty of receiving appeals, Appeals Committee. 1 2 APPEALS COMMITTEE (PSYCHOTHERAPY PROFESSION) [ S.L. 587.01 keep minutes and assume such other duties as the President of the Appeals Committee may delegate. Functions of the Appeals Committee. 4.
(1)The Appeals Committee shall hear and decide upon any appeal application filed by a person who feels aggrieved by a decision of the Board: (
- a)whereby the issuance of the warrant certificate to practice the profession of a psychotherapist is refused; or (
- b)in relation to the equivalence and recognition of qualifications in the psychotherapy profession.
(2)An appeal against the decision of the Board, shall be filed within a peremptory period of thirty
(30)days from the date of such decision, by means of a request for appeal filed with the Secretary of the Appeals Committee.
(3)The Appeals Committee shall regulate its own procedure.
(4)The Appeals Committee shall have the right to request from the Board, information in respect of any decision which is being considered by it and may request the said Board to submit to it any, or all documentation relating to the case being considered. It shall be the duty of the said Board to provide the requested information and, or any documents without delay.
(5)The Appeals Committee shall have the power to confirm, cancel or revoke with conditions or otherwise, and to substitute any decision of the said Board upon any appeal in accordance to these regulations. Appointment of experts.
- In the exercise of its functions in accordance with these regulations, the Appeals Committee may appoint experts to relate on any matter before it. Fees.
- The appellant shall pay the Appeals Committee the fee of one hundred and twenty euro (€120) in respect of each appeal from a decision of the Board.
