REGISTER OF PART-TIME EMPLOYMENT [ S.L.594.20 SUBSIDIARY LEGISLATION 594.20 REGISTER OF PART-TIME EMPLOYMENT REGULATIONS 1st January, 2008 LEGAL NOTICE 354 of 2007, as amended by Act XXVII of 2016. 1.
(1)The title of these regulations is the Register of Parttime Employment Regulations. Title and scope.
(2)The purpose of these regulations is to contribute to the flexible organization of working time taking into account the needs of workers and employers. 2. These regulations apply to persons who are seeking parttime employment and are registering for work at Jobsplus. 3.
(1)In these regulations: "Act" means the Employment and Training Services Act; Applicability. Amended by: XXVII. 2016.
- Interpretation. Cap.
- "part-time employment" means employment where the normal hours of work, calculated on a weekly basis or on an average over a period of employment of up to one year, are less than the normal hours of work of comparable full-time employment and is distinct from full-time employment with reduced hours; "principal employment" means that employment in respect of which social security contributions are payable in terms of the Social Security Act. Cap. 318.
(2)Subject to the provisions of subregulation
(1), terms and conditions used in these regulations shall, unless the context other requires, have the meaning assigned to them in the Act. 4.
(1)Without prejudice to the provision of article 11 of the Act, the Register shall consist of Part Three A for persons in gainful employment seeking alternative full-time employment; Part Th ree B for the registration of st udent s seeki ng t empo rary employment. Composition of Part Three of the Register.
(2)Part Three C for the registration of persons who are seeking part-time employment. Part Three C of the register shall consist of two sections: (
- a)Part Three C1 for those unemployed persons seeking part-time employment as their principal employment; and (
- b)Part Three C2 for persons who are seeking part-time employment and who are already in gainful Part-Time or full-time employment. 5. Persons registering in Part Three C1 of the Register may register on other parts of the register. Persons registered in Part One and not registered in Part T h r e e C 1 o f s u c h r e g i s t e r, m a y n o t b e o f f e r e d p a r t - t i m e employment. Preference given by the Corporation. 7.
(1)In referring any person for part-time employment, the Corporation shall give preference to persons registered in Part Three C1 over those registered in Part Three C2 of the Register.
(2)In referring any person for full-time employment, the Corporation shall give preference to persons registered in Part One over those registered in Parts Two and Three of the Register. Persons refusing employment without cause. 8.
(1)Without prejudice to article 13
(2)of the Act, if persons are registered in Part One and Part Three C1 and they refuse w itho ut a go od an d suffi cient cause to avail themselves of e m p l o y m e n t , t h e y s h a l l l o s e t h ei r p r i o r i t y f o r r e f e r r a l f o r employment: (a) from Part One employment; and only if they refuse full-time (b) from Part Three C1 only if they refuse part-time employment.
(2)Such person shall be notified accordingly in writing.
