  2. The title of this Scheme is the Manufacture of Jewellery and Gold and Silverware Scheme - Scheme No.
  3. Citation.
  4. In this scheme, unless the context otherwise requires, the words and expressions used shall have the same meanings as those assigned to them by the Employment and Training Services Act. Interpretation. Cap.
  6. This scheme shall apply to the calling of jeweller, jewel setter, goldsmith, silversmith and filigree worker.
  7. No person may be employed as an apprentice under this scheme unless it is shown to the satisfaction of the Director that such person has either completed the Fourth Year of a Secondary School or the full Trade School course. Employment as apprentice. Amended by: XLIV. 1965.

  10. Employers engaging apprentices under this scheme shall undertake to teach them and to grant them facilities to learn the following processes by hand: Processes to be learnt.

(1)Jeweller (
  1. a)Polishing; (
  2. b)Use of files, saw frame, blow pipes, drills and other tools; (
  3. c)The use of rules, dividers and scribers, and tracing designs on metals; (
  4. d)Rol1ing and wire drawing; (
  5. e)Use and treatment of alloys and solder; (
  6. f)Forming simple and fancy shapes in metal; (
  7. g)Making of brooch and earring fittings, joints, catches, shanks, rail claws and spring parts; soldering; doming and shaping; making of simple and fancy galleries; (
  8. h)Adjusting metal to suit precious stones; (
  9. i)Forming, moulding and casting of rings; making of simple stone and cluster rings, brooches, earrings, and bracelets (except chenier work); (
  10. j)Safety precautions in the workshop.

  1. a)Use of drills, scrapers and other tools; (
  2. b)Adjusting metals to suit gems; (
  3. c)Setting of gems on mount using claw, flush millegrain or cup type of setting; (
  4. d)Safety precautions in the workshop.
(3)Goldsmith (
  1. a)Polishing; (
  2. b)The use of files, sawframe, blow-pipes, drills and other tools; (
  3. c)The use of rules, dividers and scribers, and tracing designs on metals; (
  4. d)Rolling and wire drawing; (
  5. e)Making cheniers; (
  6. f)Forming simple and fancy shapes in metal; (
  7. g)Use and treatment of alloys and solder; (
  8. h)Making of brooch and earring fittings, joints, catches, shanks, rail claws spring parts and clip frames; soldering, doming shaping; making of simple and fancy galleries; (

  1. a)Polishing; (
  2. b)Use of files, sawframe, blow-pipes, drills, hammers, burnishers and other tools; (
  3. c)Use of rules, dividers and scribers, tracing designs on metals, (
  4. d)Use and treatment of alloys and solder; (
  5. e)Cutting out designs with piercing saw; shaping, raising, embossing and chasing; (
  6. f)Making of articles in silver by beating or cutting out from sheet metal; assembling and soldering together cast, pressed, stamped or other parts; (
  7. g)Safety precautions in the workshop.
(5)Filigree Worker (
  1. a)Use of files, blow-pipes and other tools; (
  2. b)Use of rules, dividers and gauges; (

  4. d)Making of brooches, earrings, bracelets and other objects; (
  5. e)Finishing; colour processing (if gold is used); (
  6. f)Gilding (if such process is used by the employer); (
  7. g)Safety precautions in the workshop. 6. The period of apprenticeship in any of the callings under this scheme shall be of six years: Provided that six months shall be deducted from the said period of six years, to a total deduction of not more than two years, in respect of each year of learnership in the calling, undergone by the prospective apprentice with the permission of the Director: Period of apprenticeship. Provided that in respect of contracts of apprenticeship entered into after the 1st day of January, 1970, the period of apprenticeship shall be of five years in the callings of Jeweller and Jewel Setter and of four years in the callings of Goldsmith, Silversmith and Filigree Worker. 7. The wages payable to apprentices in the callings to which this scheme applies shall be as follows: (

  9. b)when the apprenticeship lasts four years: Year First Second Third Fourth Wages per week €24.57 €30.79 €37.04 €43.26. 8.
(1)The hours of work of apprentices employed under this scheme shall not exceed nine hours in any one day: Provided that employers may employ apprentices on overtime work with the approval of the Director, who may impose such conditions as he may deem fit, at the follovaing rates of remuneration: (
  1. a)for all time worked in excess of nine hours daily: time and a half; (
  2. b)for all time worked in excess of forty-five hours in any week, exclusive of any time paid at overtime rates: time and a half; (

(2)Apprentices under 16 years of age may not be employed between 11 p.m. of any one day and 6 a.m. of the next following day. Periods of rest. Substituted by: L.N. 119 of 1969; L.N. 80 of 1979. Vacation leave. Substituted by: L.N. 119 of 1969; L.N. 77 of 1970; L.N. 86 of 1977. 9. Apprentices shall be granted one whole day of rest in every calendar week. 10. Apprentices shall be entitled, in every calendar year, to (
  1. a)all customary holidays with full pay, and (
  2. b)after three months in employment, vacation leave of such number of working days with full pay as is equivalent to the number of working days as that particular apprentice should normally attend to work during a period of four weeks: Provided that (
  3. a)all apprentices who have been in employment for less than one year shall be entitled to such part of the said vacation leave as is in proportion to the number of months in employment, and (
  4. b)vacation leave may not normally be availed of on any day when the apprentice is required to attend school for theoretical instruction. Sick leave. Added by: L.N. 119 of 1969. Cap. 318. 11.
(1)After completing the first six months of apprenticeship, apprentices shall be entitled to twenty days sick leave on full pay in every calendar year less any sickess benefit to which they may be entitled under the Social Security Act: Provided that a medical certificate certifying incapacity for work covering the period of absence is produced to the employer, who may require his medical practitioner to examine the apprentice.
(2)Apprentices shall not be entitled to the payment of any wages for the first three days of every period of sick leave: Provided that the number of unpaid days of sick leave shall not be deducted from the entitlement of paid sick leave. Bereavement leave. Added by: L.N. 119 of
  2. Apprentices shall be allowed two days paid leave on the death of any of the following: the wife, husband, mother, father (or the person who at the time was in fact acting as the mother or father), son, daughter, brother and sister of the apprentice. Customary holidays. Added by: L.N. 119 of

An apprentice shall be entitled to one year injury leave on full pay, less the full amount of any injury benefit to which an apprentice may be entitled in terms of the Social Security Act, if he is injured during the actual discharge of his duty and such injury is not due to contributory negligence on his part or to contravention by him of safety rules laid down by the management.
