MALTA COUNCIL FOR SCIENCE AND TECHNOLOGY AGENCY (ESTABLISHMENT) [ S.L.595.20 1 SUBSIDIARY LEGISLATION 595.20 MALTA COUNCIL FOR SCIENCE AND TECHNOLOGY AGENCY (ESTABLISHMENT) ORDER* 1st November, 2016 LEGAL NOTICE 366 of 2016, as amended by Legal Notice 376 of 2021. 1. The title of this Order is the Malta Council for Science and Technology Agency (Establishment) Order. 2. There shall be an Agency, to be known as the Malta Council for Science and Technology Agency, hereinafter referred to as "the Agency", which shall be autonomous and which shall carry out functions related to the commercialisation of activities related to science, technology, research and innovation. 3. The Agency shall have the following functions and duties: (
- a)to carry out merchandising and retailing, to grant and receive sponsorships, to prepare, distribute and sell publications, to organise and conduct training programmes and to hire out venues; Citation. - b)to enter into any agreement with the Malta Council for Science and Technology or the Government or with any authority, entity or person for the carrying out of any of the objects of the Agency; (
- c)to carry on any business or activity that may be considered necessary for, conducive or ancillary to or connected with any of its objects. 4.
(1)The Minister responsible for the Agency shall be the Minister who is assigned the responsibility for research and innovation or such other Minister so assigned for such purpose by the Prime Minister.
(2)The Permanent Secretary in the Ministry responsible for the Agency shall supervise the Agency in accordance with the provisions of article 29 of the Public Administration Act: Provided that the Permanent Secretary in the Ministry responsible for the Agency may be assisted in such supervision by another Permanent Secretary in accordance with the provisions of article 14
(6)of the Public Administration Act.
- The Agency shall be governed by the provisions of the Public Finance Management Act unless otherwise stated in the statute of the Agency, in which case the provisions of the statute shall prevail. *Repealed by Legal Notice 112 of

- The operations of the Agency shall follow the statute of the Agency. Head of Agency. 7.
(1)The Agency shall be headed by a Chief Executive Officer who shall perform all the functions and duties of the Chief Executive Officer as stipulated in the Public Administration Act. Cap. 595.
(2)The legal and judicial representation of the Agency shall lie in the Chief Executive Officer. Advisory Board. 8.
(1)The Minister responsible for the Agency may establish an Advisory Board to assist the Chief Executive Officer in the discharge of his duties.
(2)An advisory board established under this article shall be chaired by the Chief Executive Officer and shall consist of not less than two and not more than four members appointed by the Minister responsible for the Agency.
(3)The remuneration paid to members of the Agency’s Advisory Board shall be in accordance with any directives and guidelines which may be issued by the Agency from time to time.
