TOURISM ZONES REGENERATION AGENCY (ESTABLISHMENT) [ S.L. 595.41 1 SUBSIDIARY LEGISLATION 595.41 TOURISM ZONES REGENERATION AGENCY (ESTABLISHMENT) ORDER 22nd October, 2021 LEGAL NOTICE 399 of 2021. 1. The title of this order is the Tourism Zones Regeneration Agency (Establishment) Order. 2. Citation. In this order, unless the context otherwise requires – Interpretation. "Act" means the Public Administration Act; Cap. 595. "Agency" means the Tourism Zones Agency established by this order; "Agency Agreement" means the Agreement as provided for in article 9; "Minister" means the Minister responsible for tourism "Permanent Secretary" means the Permanent Secretary in the Ministry responsible for tourism. 3. There shall be an Agency to be known as the Tourism Zones Regeneration Agency, which shall carry out functions primarily related to the regeneration and management of areas of touristic importance. 4. The Agency shall have the function to: (

  1. a)lead in the formulation of regeneration plans with emphasis on holistic sustainable actions, proper urban design, providing liveable places that are attractive to residents and attractive landmarks for visitors to enjoy; (
  2. b)lead the implementation of the actions emanating from the regeneration plans; (
  3. c)introduce and implement fully the concept of Town-Centre Management with the involvement of local stakeholders and to focus on those aspects like security, safety and urban amenity; (
  4. d)manage beaches as an integral part of the touristic area, and implement a comprehensive strategy for effective and holistic beach management; (
  5. e)provide technical support and upkeep in main tourism areas, that is timely in its intervention in order to provide an efficient service to the business community; Establishment of the Tourism Zones Agency.   6. f)co-ordinate and monitor urban independently or in cooperation with other agencies; upkeep, (
  7. g)guide government agencies and private companies to upgrade their urban management interventions so that the service provided in the town-centre is at par with the best efficient service provided in other European countries; (
  8. h)encourage the highest levels of quality in the implementation of projects and the provision of services and amenities in touristic areas; and (
  9. i)assist in the development of a long-term investment strategy that ensures a project life-cycle. Minister responsible for Agency. 5.

(1)The Minister responsible for the Agency shall be the Minister responsible for tourism.
(2)The Minister may, from time to time, appoint a Management Committee to facilitate the management of any identified project site.
(3)The Minister shall authorise the Agency to enter into any agreement with any government entity or tourism-related nongovernmental organisation or any third party for the management of any identified project site: Provided that all necessary approvals for such management have been given by the Government Property Division according to the Laws of Malta. (1)The Agency shall, in consultation with the Minister, establish and re-organise units, divisions and sections as appropriate in order to exercise its functions.
(2)The operations of the Agency shall follow an Agreement which is to be agreed upon in writing between the Permanent Secretary and the Agency. Role of the Chief Executive Officer. 7.
(1)Subject to the other provisions of this Act, the executive conduct of the Agency, its administration and organisation and the administrative control of its officers and employees, shall be the responsibility of the Chief Executive Officer of the Agency, who shall be appointed by the Minister.
(2)The Chief Executive Officer shall be responsible for the implementation of the objectives of the Agency in the exercise of its functions and without prejudice to the generality of the foregoing he shall: (

  2. b)assign to each unit, division and section such duties which he considers necessary or expedient; (
  3. c)co-ordinate the workings of the units, divisions and sections; (
  4. d)develop the necessary strategies for implementation of the objectives of the Agency; and the (
  5. e)such other duties as the responsible Minister may assign to him from time to time. 8.
(1)Public officers deployed with the Agency shall be deemed to be detailed with the Agency in accordance with article 33 of the Act. Deployment of public officers and recruitment with the Agency.
(2)Subject to the provisions of the Act and of any other legislation, the Agency shall have authority to engage its own employees.

(1)The Minister responsible for the Agency may establish a Governing Board to assist the Chief Executive Officer and the Management Committee in the discharge of their duties. Governing Board.

(3)The remuneration paid to members of the Agency’s Governing Board shall be in accordance with any applicable directives and guidelines.
