- The title of this order is the Project Green (Establishment as an Agency) Order.
- Citation. In this order, unless the context otherwise requires: Interpretation. "Act" means the Public Administration Act; Cap.
- "Agency" means Project Green established by article 3; "Agreement" means the Agency Agreement as provided in article 7; "Minister" means the Minister responsible for Project Green; "Permanent Secretary" means the Permanent Secretary in the Ministry responsible for Project Green.
- There shall be an Agency, to be known as Project Green, which shall carry out the functions and duties of the public administration as stipulated in article

(1)The Agency shall have the following functions (
- a)to implement environmental projects and projects which provide for the embellishment and creation of green spaces and to ensure the attainment of the necessary permits for their implementation; (
- b)to distribute information, educate and develop strategies on the importance of green spaces; (
- c)to develop and implement plans and programmes for the embellishment and creation of green spaces; (
- d)to provide administrative support services in relation to environmental projects and projects providing for the embellishment and creation of green spaces including in urban areas; (
- e)to identify and make use of external sources of financing to assist in the implementation of policy, plans and 1 2 [ S.L. 595.44 PROJECT GREEN AGENCY (ESTABLISHMENT AS AN AGENCY) programmes referred to in paragraphs (
- a)and (
- b)and other policies and plans as approved by the Minister; (
- f)to enhance and build strong relationships with governmental and non-governmental environmental organisations, local and regional councils as well as with third parties that may have an interest in the implementation of environmental projects including in urban spaces; (
- g)to provide maintenance services and other ancillary services so as to safeguard the embellishment of green spaces; (
- h)to carry out any other functions related to the embellishment and creation of green spaces which may, from time to time, be decided by the Minister.
(2)The functions and duties of the Agency shall be executed in co-ordination with government entities and authorities and in the case of projects on a national or European level, with the person or authority that may, from time to time, be the responsible competent authority for the said functions. The Permanent Secretary in the Ministry responsible for Project Green shall supervise the Agency in terms of article 29 of the Act: Provided that the Permanent Secretary in the Ministry responsible for Project Green may be assisted in such supervision by another Permanent Secretary in accordance with the proviso to article 14
(6)of the Act. Agency to be subject to the Act.
- The Agency shall be subject to the provisions of Title 2 of Part III of the Act and shall be regulated by the said provisions. Agreement.
- The operations of the Agency shall be carried out in accordance with an Agreement to be agreed upon between the Permanent Secretary and the Agency. Chief Executive Officer. 8.
(1)Subject to the other provisions of this order, the executive conduct of the Agency, its administration and organisation and the administrative control of its officers and employees, shall be the responsibility of the Chief Executive Officer, who shall be appointed by the Minister.
(2)The Chief Executive Officer shall be responsible for the implementation of the objectives of the Agency in the exercise of its functions and, without prejudice to the generality of the foregoing, he shall: (
- a)assume full responsibility for the overall PROJECT GREEN AGENCY (ESTABLISHMENT AS AN AGENCY) [ S.L. 595.44 3 supervision and control of the units, divisions and sections; (
- b)assign to each unit, division and section such duties which he considers necessary or expedient; (
- c)co-ordinate the workings of the units, divisions and sections; (
- d)develop the necessary strategies for implementation of the objectives of the Agency; and the (
- e)perform such other duties as the Minister responsible may assign to him from time to time. 9.
(1)The public officers deployed with the Agency shall be deemed to be detailed with the Agency in accordance with article 33 of the Act. Deployment of public officers and recruitment with the Agency.
(2)Subject to the provisions of the Act and of any other legislation, the Agency shall have authority to engage its own employees. 10. The Agency shall be governed by the provisions of the Public Finance Management Act unless otherwise stated in the Agreement, in which case the provisions of the Agreement shall prevail.
