REGISTRATION OF SUMMER SCHOOLS AS EDUCATIONAL ESTABLISHMENTS [ S.L.605.08 SUBSIDIARY LEGISLATION 605.08 REGISTRATION OF SUMMER SCHOOLS AS EDUCATIONAL ESTABLISHMENTS REGULATIONS 9th June, 2009 LEGAL NOTICE 185 of 2009, as amended by Act XXIX of

  1. The title of these regulations is the Registration of Summer Schools as Educational Establishments Regulations.
  2. In these regulations, unless the context requires otherwise: "the Act" means the Education Act; Title. Interpretation. Amended by: XXIX.2019.
  3. Cap.
  4. "the Directorate" means the Directorate for Quality and Standards in Education; "person in charge" means any person who is co-ordinating the s p or t , c ul t u r a l , m u s i c a l or o t h e r a c t iv i t i e s i n c l u d e d i n a ny programme organised in a Summer School; "Summer School" means any programme offered during the months of June to September of any year, for children between three and sixteen years of age providing informal education through creative, cultural, recreational and sport activities and not leading to formal certificates. 3.

(1)Any person in charge of a Summer School shall apply to the Minister to register that Summer School as an educational establishment under the Act.
(2)The Directorate may accept an application if: (
  1. a)it is duly filled in and accompanied with all necessary documentation; and (
  2. b)in its opinion, it meets the criteria established in these regulations.
(3)The documentation accompanying the application shall include: (
  1. a)a clear description of all activities included in the offered programme together with details regarding the educational value of such programme; and (
  2. b)information regarding all fees and, or expenses which may be requested from the participants at the Summer School.
(4)Registration of a Summer School shall be valid for a period between June and September of any one year and an application for registration shall be submitted annually to the Directorate, accompanied by all necessary documentation.

When the entity applying for registration under these regulations is also licensed to operate as a school under the Act, the programme offered by the Summer School shall not be the same as, or a continuation of, the programme of studies offered by the school during the scholastic year. (1)No class in a Summer School shall exceed fifteen participants where any one of the children is between three and nine years old. Where all the children are between ten and sixteen years old, no class shall exceed twenty participants.
(2)On the premises where the Summer School is held there shall be at least one person with a first aid qualification present at all times.
(3)In activities which are held outside the school premises, or which involve swimming or travel by air or by sea, there shall be an extra adult for every two classes of participants. In any case, the person in charge shall ensure that all necessary measures for the health and safety of the participants are taken. Fees and other expenses.
  1. The person in charge shall, before accepting any child to any offered programme, inform the parents of the participants about any fees and, or other expenses involved. Educational establishment.
  2. Registration of a Summer School under these regulations shall, for the applicable period, mean that such school is to be considered as an educational establishment registered under the Act.
