ESTABLISHMENT AND COMPOSITION OF THE NATIONAL PLATFORM FOR THE PREVENTION OF CORRUPTION IN SPORT [ S.L. 626.03 SUBSIDIARY LEGISLATION 626.03 ESTABLISHMENT AND COMPOSITION OF THE NATIONAL PLATFORM FOR THE PREVENTION OF CORRUPTION IN SPORT REGULATIONS 1st March, 2024 LEGAL NOTICE 40 of 2024, as amended by Legal Notice 208 of 2024. 1. The title of these regulations is the Establishment and Composition of the National Platform for the Prevention of Corruption in Sport Regulations. Citation. 2. requires: Interpretation.

(1)In these regulations, unless the context otherwise "Act" means the Sports Governance and Integrity Act; "administrator" means the person who performs administrative work with respect to the operation of the platform and who shall also be vested with the capacity to act as a controller in terms of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) "Authority" means the Authority for Integrity in Maltese Sport established by article 5 and any reference in these regulations or any other law to the Authority shall, unless the context otherwise requires, be construed as including a reference to any person authorised by the Authority to act for or on its behalf; "Minister" means the Minister responsible for sports; "platform" means the National Platform for the Prevention of Corruption in Sport established by regulation 3; "sport organisation" means a federation or a national federation or an association or a national association or club or foundation having sport as its main objective or an academy or sport school or any other person registered in the Authority’s Register for Sport Persons or an organisation having sport as its main objective and which for any reason whatsoever is not yet registered in the said Register. (2)The definitions prescribed in the Prevention of Corruption in Sport Act shall apply, mutatis mutandis, unless they are inconsistent with these regulations.

(1)There shall be a national platform for the Prevention of Corruption in Sport which shall be known as "the platform".
(2)The platform shall have a legal personality distinct and independent from the Authority in order to carry out all the actions referred to in article 44 of the Act.

  1. a)to collect and analyse information relevant to investigations relating to suspected manipulation of sport events and to share the information with other national and international entities of a similar nature in accordance with the National Platform for the Prevention of Corruption in Sport (Powers and Obligations) Regulations and the Prevention of Corruption in Sport Act; (
  2. b)to analyse alerts stemming from betting monitoring systems and other platforms whose function includes the detection of suspicious betting activities; (
  3. c)to act as an information hub; (
  4. d)to assist the police and sport organisations in the production of evidence arising from information collected for the purpose of prosecution of criminal cases as well as disciplinary proceedings of a sporting nature respectively. Responsibilities of the Authority. 4.
(1)The Authority shall always be responsible for establishing policies and strategies for fighting manipulation of sport results as well as the drawing up of educational programmes and the dissemination of information in collaboration with the national associations and federations and the Directorates for Education.
(2)The Authority shall provide sport organisations with standards for the purpose of establishing procedures and regulations that assist with the fight against manipulation of sport results. Sport organisations shall comply with these standards and in default of conformity with such standards they shall be liable to an administrative penalty of not less than one hundred euro (€100) and not exceeding one thousand euro (€1,000). (1)The platform shall be composed of interested national entities which are most impacted by the risk of corruption in sport, in particular from: 3 Composition of the platform. Amended by: L.N. 208 of 2024. (
  1. a)a representative nominated by the Ministry responsible for Sport; (
  2. b)a representative nominated by the Ministry responsible for Home Affairs; (
  3. c)two
(2)representatives nominated by the Authority in the grade of Director or higher within the Authority, one
(1)of whom shall be appointed chairperson of the platform; (
  1. d)a representative from the Police Force in the grade of Police Inspector or a higher grade officer, who shall be the official responsible for sport manipulation matters; (
  2. e)a representative from the Malta Gaming Authority having been given a written delegation by the Chief Executive Officer of the said authority, who shall be the official responsible for sport manipulation matters; (
  3. f)a representative from the Maltese Olympic Committee who shall be qualified in sport and an expert in integrity in sport; and (
  4. g)a representative of the Malta Football Association who holds the position of Integrity Officer within the said association.
(2)The Minister may, on the advice of the Authority, increase or change the representation on the platform by means of regulations made under the Act. The said amendments shall only take place in the event that the trends relating to the objectives of the platform change from time to time.
(3)The number of members shall not be more than eleven

(4)The legal and judicial representation of the platform shall vest in the Chairperson and in the administrator of the platform. 6. Authority.
