Présente à juger une question de compétence soulevant une difficulté sérieuse mettant en jeu la séparation des autorités administratives et judiciaires et justifiant un renvoi préjudiciel devant le Tribunal des Conflits le litige opposant une caisse primaire d'assurance maladie à une commune au sujet du remboursement des prestations servies à l'occasion d'une rechute à un agent communal qui, à la date de l'accident dont il a été victime au cours de son travail, n'avait pas la qualité d'agent titulaire mais a été titularisé postérieurement avec effet rétroactif dès lors qu'un tel litige concerne une action dirigée contre une collectivité locale et fondée sur les obligations qui lui incomberaient en vertu des dispositions régissant les accidents de service des fonctionnaires.
