Īsumā

Šis likums apstiprina Eiropas Cilvēka tiesību un pamatbrīvību aizsardzības konvenciju un tās piecus protokolus, padarot tos saistošus Latvijas Republikai. Tas nosaka Latvijas atbildību par šo tiesību ievērošanu un atzīst starptautisko institūciju kompetenci izskatīt sūdzības par to pārkāpumiem.

Human Rights proclaimed by the General Assembly

the United Nations on 10th December 1948;Considering that this Declaration aims at securing the universal and effective recognition and observance

the Rights therein declared;Considering that the aim

the Council

Europe is the achievement

greater unity between its members and that one

the methods by which that aim is to be pursued is the maintenance and further realisation

human rights and fundamental freedoms;Reaffirming their profound belief in those fundamental freedoms which are the foundation

justice and peace in the world and are best maintained on the one hand by an effective political democracy and on the other by a common understanding and observance

the human rights upon which they depend;Being resolved, as the governments

European countries which are like-minded and have a common heritage

political traditions, ideals, freedom and the rule

law, to take the first steps for the collective enforcement

the rights stated in the Universal Declaration,Have agreed as follows:Article 1The High Contracting Parties shall secure to everyone within their jurisdiction the rights and freedoms defined in Section I

this Convention.SECTION IArticle 21. Everyone's right to life shall be protected by law. No one shall be deprived

his life intentionally save in the execution

a court following his conviction

a crime for which this penalty is provided by law.2. Deprivation

life shall not be regarded as inflicted in contravention

this article when it results from the use

force which is no more than absolutely necessary:a. in defence

any person from unlawful violence;b. in order to effect a lawful arrest or to prevent the escape

a person lawfully detained;c. in action lawfully taken for the purpose

quelling a riot or insurrection.Article 3No one shall be subjected to torture or to inhuman or degrading treatment or punishment.Article

  1. No one shall be held in slavery or servitude.
  2. No one shall be required to perform forced or compulsory labour.
  3. For the purpose

this article the term "forced or compulsory labour" shall not include:a. any work required to be done in the ordinary course

detention imposed according to the provisions

Article 5

this Convention or during conditional release from such detention;b. any service

a military character or, in case

conscientious objectors in countries where they are recognised, service exacted instead

compulsory military service;c. any service exacted in case

an emergency or calamity threatening the life or well-being

the community;d. any work or service which forms part

normal civic obligations.Article 51. Everyone has the right to liberty and security

person. No one shall be deprived

his liberty save in the following cases and in accordance with a procedure prescribed by law:a. the lawful detention

a person after conviction by a competent court;b. the lawful arrest or detention

a person for non- compliance with the lawful order

a court or in order to secure the fulfilment

any obligation prescribed by law;c. the lawful arrest or detention

a person effected for the purpose

bringing him before the competent legal authority on reasonable suspicion

having committed an

fence or when it is reasonably considered necessary to prevent his committing an

fence or fleeing after having done so;d. the detention

a minor by lawful order for the purpose

educational supervision or his lawful detention for the purpose

bringing him before the competent legal authority;e. the lawful detention

persons for the prevention

the spreading

infectious diseases,

persons

unsound mind, alcoholics or drug addicts or vagrants;f. the lawful arrest or detention

a person to prevent his effecting an unauthorised entry into the country or

a person against whom action is being taken with a view to deportation or extradition.2. Everyone who is arrested shall be informed promptly, in a language which he understands,

the reasons for his arrest and

any charge against him.3. Everyone arrested or detained in accordance with the provisions

paragraph 1.c

this article shall be brought promptly before a judge or other

ficer authorised by law to exercise judicial power and shall be entitled to trial within a reasonable time or to release pending trial. Release may be conditioned by guarantees to appear for trial.4. Everyone who is deprived

his liberty by arrest or detention shall be entitled to take proceedings by which the lawfulness

his detention shall be decided speedily by a court and his release ordered if the detention is not lawful.5. Everyone who has been the victim

arrest or detention in contravention

the provisions

this article shall have an enforceable right to compensation.Article 61. In the determination

his civil rights and obligations or

any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. Judgment shall be pronounced publicly but the press and public may be excluded from all or part

the trial in the interests

morals, public order or national security in a democratic society, where the interests

juveniles or the protection

the private life

the parties so require, or to the extent strictly necessary in the opinion

the court in special circumstances where publicity would prejudice the interests

justice.2. Everyone charged with a criminal

fence shall be presumed innocent until proved guilty according to law.3. Everyone charged with a criminal

fence has the following minimum rights:a. to be informed promptly, in a language which he understands and in detail,

the nature and cause

the accusation against him;b. to have adequate time and facilities for the preparation

his defence;c. to defend himself in person or through legal assistance

his own choosing or, if he has not sufficient means to pay for legal assistance, to be given it free when the interests

justice so require;d. to examine or have examined witnesses against him and to obtain the attendance and examination

witnesses on his behalf under the same conditions as witnesses against him;e. to have the free assistance

an interpreter if he cannot understand or speak the language used in court.Article 71. No one shall be held guilty

any criminal

fence on account

any act or omission which did not constitute a criminal

fence under national or international law at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the criminal

fence was committed.2. This article shall not prejudice the trial and punishment

any person for any act or omission which, at the time when it was committed, was criminal according to the general principles

law recognised by civilised nations.Article

  1. Everyone has the right to respect for his private and family life, his home and his correspondence.
  2. There shall be no interference by a public authority with the exercise

this right except such as is in accordance with the law and is necessary in a democratic society in the interests

national security, public safety or the economic well-being

the country, for the prevention

disorder or crime, for the protection

health or morals, or for the protection

the rights and freedoms

others.Article 91. Everyone has the right to freedom

thought, conscience and religion; this right includes freedom to change his religion or belief and freedom, either alone or in community with others and in public or private, to manifest his religion or belief, in worship, teaching, practice and observance.2. Freedom to manifest one's religion or beliefs shall be subject only to such limitations as are prescribed by law and are necessary in a democratic society in the interests

public safety, for the protection

public order, health or morals, or for the protection

the rights and freedoms

others.Article 101. Everyone has the right to freedom

expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless

frontiers. This article shall not prevent States from requiring the licensing

broadcasting, television or cinema enterprises.2. The exercise

these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests

national security, territorial integrity or public safety, for the prevention

disorder or crime, for the protection

health or morals, for the protection

the reputation or rights

others, for preventing the disclosure

information received in confidence, or for maintaining the authority and impartiality

the judiciary.Article 111. Everyone has the right to freedom

peaceful assembly and to freedom

association with others, including the right to form and to join trade unions for the protection

his interests.2. No restrictions shall be placed on the exercise

these rights other than such as are prescribed by law and are necessary in a democratic society in the interests

national security or public safety, for the prevention

disorder or crime, for the protection

health or morals or for the protection

the rights and freedoms

others. This article shall notprevent the imposition

lawful restrictions on the exercise

these rights by members

the armed forces,

the police or

the administration

the State.Article 12Men and women

marriageable age have the right to marry and to found a family, according to the national laws governing the exercise

this right.Article 13Everyone whose rights and freedoms as set forth in this Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an

ficial capacity.Article 14The enjoyment

the rights and freedoms set forth in this Convention shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status.Article 151. In time

war or other public emergency threatening the life

the nation any High Contracting Party may take measures derogating from its obligations under this Convention to the extent strictly required by the exigencies

the situation, provided that such measures are not inconsistent with its other obligations under international law.2. No derogation from Article 2, except in respect

deaths resulting from lawful acts

war, or from Articles 3, 4 (paragraph 1) and 7 shall be made under this provision.3. Any High Contracting Party availing itself

this right

derogation shall keep the Secretary General

the Council

Europe fully informed

the measures which it has taken and the reasons therefor. It shall also inform the Secretary General

the Council

Europe when such measures have ceased to operate and the provisions

the Convention are again being fully executed.Article 16Nothing in Articles 10, 11 and 14 shall be regarded as preventing the High Contracting Parties from imposing restrictions on the political activity

aliens.Article 17Nothing in this Convention may be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction

any

the rights and freedoms set forth herein or at their limitation to a greater extent than is provided for in the Convention.Article 18The restrictions permitted under this Convention to the said rights and freedoms shall not be applied for any purpose other than those for which they have been prescribed.SECTION IIArticle 19To ensure the observance

the engagements undertaken by the High Contracting Parties in the present Convention, there shall be set up:a. a European Commission

Human Rights, hereinafter referred to as "the Commission";b. a European Court

Human Rights, hereinafter referred to as "the Court".SECTION IIIArticle 2011. The Commission shall consist

a number

members equal to that

the High Contracting Parties. No two members

the Commission may be nationals

the same State.2. The Commission shall sit in plenary session. It may, however, set up Chambers, each composed

at least seven members. The Chambers may examine petitions submitted under Article 25

this Convention which can be dealt with on the basis

established case law or which raise no serious question affecting the interpretation or application

the Convention. Subject to this restriction and to the provisions

paragraph 5

this article, the Chambers shall exercise all the powers conferred on the Commission by the Convention.The member

the Commission elected in respect

a High Contracting Party against which a petition has been lodged shall have the right to sit on a Chamber to which the petition has been referred.3. The Commission may set up committees, each composed

at least three members, with the power, exercisable by a unanimous vote, to declare inadmissible or strike from its list

cases a petition submitted under Article 25, when such a decision can be taken without further examination.4. A chamber or committee may at any time relinquish jurisdiction in favour

the plenary Commission which may also order the transfer to it

any petition referred to a Chamber or committee.5. Only the plenary Commission can exercise the following powers:a. the examination

applications submitted under Article 24;b. the bringing

a case before the Court in accordance with Article 48.a;c. the drawing up

rules

procedure in accordance with Article 36.Article 2121. The members

the Commission shall be elected by the Committee

Ministers by an absolute majority

votes, from a list

names drawn up by the Bureau

the Consultative Assembly; each group

the Representatives

the High Contracting Parties in the Consultative Assembly shall put forward three candidates,

whom two at least shall be its nationals.2. As far as applicable, the same procedure shall be followed to complete the Commission in the event

other States subsequently becoming Parties to this Convention, and in filling casual vacancies.3. The candidates shall be

high moral character and must either possess the qualifications required for appointment to high judicial

fice or be persons

recognised competence in national or international law.Article 2231. The members

the Commission shall be elected for a period

six years. They may be re-elected. However,

the members elected at the first election, the terms

seven members shall expire at the end

three years.2. The members whose terms are to expire at the end

the initial period

three years shall be chosen by lot by the Secretary General

the Council

Europe immediately after the first election has been completed.3. In order to ensure that, as far as possible, one half

the membership

the Commission shall be renewed every three years, the Committee

Ministers may decide, before proceeding to any subsequent election, that the term or terms

fice

one or more members to be elected shall be for a period other than six years but not more than nine and not less than three years.4. In cases where more than one term

fice is involved and the Committee

Ministers applies the preceding paragraph, the allocation

the terms

fice shall be effected by the drawing

lots by the Secretary General, immediately after the election.5. A member

the Commission elected to replace a member whose term

fice has not expired shall hold

fice for the remainder

his predecessor's term.6. The members

the Commission shall hold

fice until replaced. After having been replaced, they shall continue to deal with such cases as they already have under consideration.Article 234The members

the Commission shall sit on the Commission in their individual capacity. During their term

fice they shall not hold any position which is incompatible with their independence and impartiality as members

the Commission or the demands

this

fice.Article 24Any High Contracting Party may refer to the Commission, through the Secretary General

the Council

Europe, any alleged breach

the provisions

the Convention by another High Contracting Party.Article 251. The Commission may receive petitions addressed to the Secretary General

the Council

Europe from any person, non-governmental organisation or group

individuals claiming to be the victim

a violation by one

the High Contracting Parties

the rights set forth in this Convention, provided that the High Contracting Party against which the complaint has been lodged has declared that it recognises the competence

the Commission to receive such petitions. Those

the High Contracting Parties who have made such a declaration undertake not to hinder in any way the effective exercise

this right.

  1. Such declarations may be made for a specific period.
  2. The declarations shall be deposited with the Secretary General

the Council

Europe who shall transmit copies thereof to the High Contracting Parties and publish them.4. The Commission shall only exercise the powers provided for in this article when at least six High Contracting Parties are bound by declarations made in accordance with the preceding paragraphs.Article 26The Commission may only deal with the matter after all domestic remedies have been exhausted, according to the generally recognised rules

international law, and within a period

six months from the date on which the final decision was taken.Article 271. The Commission shall not deal with any petition submitted under Article 25 which:a. is anonymous, orb. is substantially the same as a matter which has already been examined by the Commission or has already been submitted to another procedure

international investigation or settlement and if it contains no relevant new information.2. The Commission shall consider inadmissible any petition submitted under Article 25 which it considers incompatible with the provisions

the present Convention, manifestly ill-founded, or an abuse

the right

petition.

  1. The Commission shall reject any petition referred to it which it considers inadmissible under Article 26.Article
  2. In the event

the Commission accepting a petition referred to it:a. it shall, with a view to ascertaining the facts, undertake together with the representatives

the parties an examination

the petition and, if need be, an investigation, for the effective conduct

which the States concerned shall furnish all necessary facilities, after an exchange

views with the Commission;b. it shall at the same time place itself at the disposal

the parties concerned with a view to securing a friendly settlement

the matter on the basis

respect for human rights as defined in this Convention.2. If the Commission succeeds in effecting a friendly settlement, it shall draw up a report which shall be sent to the States concerned, to the Committee

Ministers and to the Secretary General

the Council

Europe for publication. This report shall be confined to a brief statement

the facts and

the solution reached.Article 296After it has accepted a petition submitted under Article 25, the Commission may nevertheless decide by a majority

two-thirds

its members to reject the petition if, in the course

its examination, it finds that the existence

one

the grounds for non-acceptance provided for in Article 27 has been established.In such a case, the decision shall be communicated to the Parties.Article 3071. The Commission may at any stage

the proceedings decide to strike a petition out

its list

cases where the circumstances lead to the conclusion that:a. the applicant does not intend to pursue his petition, orb. the matter has been resolved, orc. for any other reason established by the Commission, it is no longer justified to continue the examination

the petition.However, the Commission shall continue the examination

a petition if respect for human rights as defined in this Convention so requires.2. If the Commission decides to strike a petition out

its list after having accepted it, it shall draw up a report which shall contain a statement

the facts and the decision striking out the petition together with the reasons therefore. The report shall be transmitted to the Parties, as well as to the Committee

Ministers for information. The Commission may publish it.3. The Commission may decide to restore a petition to its list

cases if it considers that the circumstances justify such a course.Article 3181. If the examination

a petition has not been completed in accordance with Article 28 (paragraph 2), 29 or 30, the Commission shall draw up a report on the facts and state its opinion as to whether the facts found disclose a breach by the State concerned

its obligations under the Convention. The individual opinions

members

the Commission on this point may be stated in the report.2. The report shall be transmitted to the Committee

Ministers. It shall also be transmitted to the States concerned, who shall not be at liberty to publish it.3. In transmitting the report to the Committee

Ministers the Commission may make such proposals as it thinks fit.Article 321. If the question is not referred to the Court in accordance with Article 48

this Convention within a period

three months from the date

the transmission

the report to the Committee

Ministers, the Committee

Ministers shall decide by a majority

two-thirds

the members entitled to sit on the Committee whether there has been a violation

the Convention.2. In the affirmative case the Committee

Ministers shall prescribe a period during which the High Contracting Party concerned must take the measures required by the decision

the Committee

Ministers.3. If the High Contracting Party concerned has not taken satisfactory measures within the prescribed period, the Committee

Ministers shall decide by the majority provided for in paragraph 1 above what effect shall be given to its original decision and shall publish the report.4. The High Contracting Parties undertake to regard as binding on them any decision which the Committee

Ministers may take in application

the preceding paragraphs.Article 33The Commission shall meet in camera.Article 349Subject to the provisions

Articles 20 (paragraph 3) and 29, the Commission shall take its decisions by a majority

the members present and voting.Article 35The Commission shall meet as the circumstances require. The meetings shall be convened by the Secretary General

the Council

Europe.Article 36The Commission shall draw up its own rules

procedure.Article 37The Secretariat

the Commission shall be provided by the Secretary General

the Council

Europe.SECTION IVArticle 38The European Court

Human Rights shall consist

a number

judges equal to that

the members

the Council

Europe. No two judges may be nationals

the same State.Article 391. The members

the Court shall be elected by the Consultative Assembly by a majority

the votes cast from a list

persons nominated by the members

the Council

Europe; each member shall nominate three candidates,

whom two at least shall be its nationals.2. As far as applicable, the same procedure shall be followed to complete the Court in the event

the admission

new members

the Council

Europe, and in filling casual vacancies.3. The candidates shall be

high moral character and must either possess the qualifications required for appointment to high judicial

fice or be jurisconsults

recognised competence.Article 40101. The members

the Court shall be elected for a period

nine years. They may be re-elected. However,

the members elected at the first election the terms

four members shall expire at the end

three years, and the terms

four more members shall expire at the end

six years.2. The members whose terms are to expire at the end

the initial periods

three and six years shall be chosen by lot by the Secretary General immediately after the first election has been completed.3. In order to ensure that, as far as possible, one-third

the membership

the Court shall be renewed every three years, the Consultative Assembly may decide, before proceeding to any subsequent election, that the term or terms

fice

one or more members to be elected shall be for a period other than nine years but not more than twelve and not less than six years.4. In cases where more than one term

fice is involved and the Consultative Assembly applies the preceding paragraph, the allocation

the terms

fice shall be effected by the drawing

lots by the Secretary General, immediately after the election.5. A member

the Court elected to replace a member whose term

fice has not expired shall hold

fice for the remainder

fice.Article 4111The Court shall elect its President and one or two Vice-Presidents for a period

three years. They may be re-elected.Article 42The members

the Court shall receive for each day

duty a compensation to be determined by the Committee

Ministers.Article 4312For the consideration

each case brought before it the Court shall consist

a Chamber composed

nine judges. There shall sit as an ex

ficio member

the Chamber the judge who is a national

any State party concerned, or, if there is none, a person

its choice who shall sit in the capacity

judge; the names

the other judges shall be chosen by lot by the President before the opening

the case.Article 44Only the High Contracting Parties and the Commission shall have the right to bring a case before the Court.Article 45The jurisdiction

the Court shall extend to all cases concerning the interpretation and application

the present Convention which the High Contracting Parties or the Commission shall refer to it in accordance with Article 48.Article 461. Any

the High Contracting Parties may at any time declare that it recognises as compulsory ipso facto and without special agreement the jurisdiction

the Court in all matters concerning the interpretation and application

the present Convention.2. The declarations referred to above may be made unconditionally or on condition

reciprocity on the part

several or certain other High Contracting Parties or for a specified period.3. These declarations shall be deposited with the Secretary General

the Council

Europe who shall transmit copies thereof to the High Contracting Parties.Article 47The Court may only deal with a case after the Commission has acknowledged the failure

efforts for a friendly settlement and within the period

three months provided for in Article 32.Article 48The following may bring a case before the Court, provided that the High Contracting Party concerned, if there is only one, or the High Contracting Parties concerned, if there is more than one, are subject to the compulsory jurisdiction

the Court or, failing that, with the consent

the High Contracting Party concerned, if there is only one, or

the High Contracting Parties concerned if there is more than one:a. the Commission;b. a High Contracting Party whose national is alleged to be a victim;c. a High Contracting Party which referred the case to the Commission;d. a High Contracting Party against which the complaint has been lodged.Article 49In the event

dispute as to whether the Court has jurisdiction, the matter shall be settled by the decision

the Court.Article 50If the Court finds that a decision or a measure taken by a legal authority or any other authority

a High Contracting Party is completely or partially in conflict with the obligations arising from the present Convention, and if the internal law

the said Party allows only partial reparation to be made for the consequences

this decision or measure, the decision

the Court shall, if necessary, afford just satisfaction to the injured party.Article 511. Reasons shall be given for the judgment

the Court.2. If the judgment does not represent in whole or in part the unanimous opinion

the judges, any judge shall be entitled to deliver a separate opinion.Article 52The judgment

the Court shall be final.Article 53The High Contracting Parties undertake to abide by the decision

the Court in any case to which they are Parties.Article 54The judgment

the Court shall be transmitted to the Committee

Ministers which shall supervise its execution.Article 55The Court shall draw up its own rules and shall determine its own procedure.Article 561. The first election

the members

the Court shall take place after the declarations by the High Contracting Parties mentioned in Article 46 have reached a total

eight.2. No case can be brought before the Court before this election.SECTION VArticle 57On receipt

a request from the Secretary General

the Council

Europe any High Contracting Party shall furnish an explanation

the manner in which its internal law ensures the effective implementation

any

the provisions

the Convention.Article 58The expenses

the Commission and the Court shall be borne by the Council

Europe.Article 59The members

the Commission and

the Court shall be entitled, during the discharge

their functions, to the privileges and immunities provided for in Article 40

the Statute

the Council

Europe and in the agreements made thereunder.Article 60Nothing in this Convention shall be construed as limiting or derogating from any

the human rights and fundamental freedoms which may be ensured under the laws

any High Contracting Party or under any other agreement to which it is a Party.Article 61Nothing in this Convention shall prejudice the powers conferred on the Committee

Europe.Article 62The High Contracting Parties agree that, except by special agreement, they will not avail themselves

treaties, conventions or declarations in force between them for the purpose

submitting, by way

petition, a dispute arising out

the interpretation or application

this Convention to a means

settlement other than those provided for in this Convention.Article 631. Any State may at the time

its ratification or at any time thereafter declare by notification addressed to the Secretary General

Europe that the present Convention shall extend to all or any

the territories for whose international relations it is responsible.2. The Convention shall extend to the territory or territories named in the notification as from the thirtieth day after the receipt

this Convention shall be applied in such territories with due regard, however, to local requirements.4. Any State which has made a declaration in accordance with paragraph 1

this article may at any time thereafter declare on behalf

individuals in accordance with Article 25

the present Convention.Article 641. Any State may, when signing this Convention or when depositing its instrument

ratification, make a reservation in respect

a general character shall not be permitted under this article.2. Any reservation made under this article shall contain a brief statement

the law concerned.Article 651. A High Contracting Party may denounce the present Convention only after the expiry

five years from the date on which it became a party to it and after six months' notice contained in a notification addressed to the Secretary General

releasing the High Contracting Party concerned from its obligations under this Convention in respect

inadmissibility by committeesA committee may, by a unanimous vote, declare inadmissible or strike out

  5. Ikviena tiesības uz dzīvību aizsargā likums. Nevienam nedrīkst ar nolūku atņemt dzīvību, izņemot ja tiek izpildīts tiesas spriedums pēc apsūdzības noziegumā, par kuru likums paredz šādu sodu.

Dzīvības atņemšana netiek uzskatīta par šī panta nosacījumu pārkāpumu, ja tā notiek spēka pielietošanas rezultātā, nepārsniedzot galējas nepieciešamības robežas:a. aizstāvot jebkuru personu pret nelikumīgu vardarbību;b. lai veiktu likumīgu arestu vai aizkavētu likumīgi arestētas personas izbēgšanu;c. veicot likumīgas darbības ar nolūku savaldīt dumpi vai sacelšanos.

  9. Nevienu cilvēku nedrīkst turēt verdzībā vai nebrīvē.
  10. Nevienam cilvēkam nedrīkst likt veikt piespiedu vai obligātu darbu.
  11. Šajā pantā termins "piespiedu vai obligāts darbs" neietver:a. jebkuru darbu, kas parasti tiek likts veikt ieslodzījuma laikā, kas piespriests saskaņā ar šīs Konvencijas
  12. panta nosacījumiem, vai nosacīti atbrīvojot no šāda ieslodzījuma;b. jebkuru militāra rakstura dienestu, vai ja notiek apzināta atteikšanās no dienesta tajās valstīs, kur tas tiek atzīts, dienestu, kas jāveic obligātā militārā dienesta vietā;c. jebkuru dienestu ārkārtējā stāvokļa vai stihiskas nelaimes gadījumā, kas apdraud sabiedrības labklājību.d. jebkuru darbu vai dienestu, kas ietilpst parastajos pilsoņa pienākumos.

  14. Ikvienam cilvēkam ir tiesības uz brīvību un personas neaizskaramību. Nevienam nedrīkst atņemt brīvību, izņemot sekojošos gadījumos un likumā noteiktā kārtībā:a. ja kāda persona tiek likumīgi aizturēta uz kompetentas tiesas sprieduma pamata;b. ja kāda persona tiek likumīgi arestēta vai aizturēta par nepakļaušanos likumīgam tiesas spriedumam vai lai nodrošinātu jebkuru likumā paredzētu saistību izpildi;c. ja kāda persona tiek likumīgi arestēta vai aizturēta ar nolūku nodot viņu kompetentiem juridiskiem orgāniem, balstoties uz pamatotām aizdomām, ka šī persona ir pārkāpusi likumu, vai ja ir pamatots iemesls uzskatīt par nepieciešamu aizkavēt viņu izdarīt likumpārkāpumu vai nepieļaut viņa bēgšanu pēc likumpārkāpuma izdarīšanas;d. ja likumīgā kārtā tiek aizturēts nepilngadīgais vai nu pāraudzināšanas nolūkā, vai lai nodotu viņu kompetentiem juridiskiem orgāniem;e. ja likumīgi tiek aizturētas personas ar nolūku aizkavēt infekcijas slimību izplatīšanos, vai garīgi slimas personas, alkoholiķi vai narkomāni, vai klaidoņi;f. ja likumīgi tiek arestēta vai aizturēta kāda persona ar nolūku neļaut šai personai nelikumīgi iebraukt valstī, vai ja attiecībā pret kādu personu tiek veiktas darbības ar nolūku šo personu deportēt vai izraidīt no valsts.
  15. Ikvienu arestētu personu nekavējoties jāinformē viņam saprotamā valodā par aresta iemesliem un par jebkuru viņam uzrādīto apsūdzību.
  16. Jebkura persona, kas arestēta vai aizturēta saskaņā ar šī panta 1.c. apakšpunktu, ir nekavējoties nododama tiesnesim vai citai amatpersonai, kura saskaņā ar likumu ir pilnvarota realizēt tiesu varu, un ir pakļaujama tiesas procesam saprātīgās laika robežās vai līdz tiesas procesam atbrīvojama. Atbrīvošanas nosacījums var būt atkarīgs no garantijām par ierašanos tiesā.
  17. Jebkura persona, kurai aresta vai aizturēšanas ceļā atņemta brīvība, var ierosināt procesu, kurā tiesa nekavējoties nosaka viņa aizturēšanas likumīgumu un nolemj viņu atbrīvot, ja aizturēšana nav bijusi likumīga.
  18. Ikvienai personai, kas ir kļuvusi par aresta vai aizturēšanas upuri pretēji šī panta nosacījumiem, ir jābūt nodrošinātām tiesībām uz kompensāciju.
  19. pants
  20. Ikvienam ir tiesības, nosakot civilo tiesību un pienākumu vai viņam izvirzītās apsūdzības pamatotību, uz taisnīgu un atklātu lietas savlaicīgu izskatīšanu neatkarīgā un objektīvā likumā noteiktā tiesā. Tiesas spriedumu jādara publiski zināmu, taču preses un publikas klātbūtne procesā var tikt pilnībā vai daļēji aizliegta morālu apsvērumu, sabiedriskās kārtības vai valsts drošības interesēs tādā demokrātiskā sabiedrībā, kur to prasa nepilngadīgo intereses vai procesa dalībnieku privātās dzīves drošība, vai arī tajā apmērā, kuru tiesa uzskata par absolūti nepieciešamu īpašos apstākļos, kad atklātība apdraudētu justīcijas intereses.
  21. Ikviens, kas tiek apsūdzēts kriminālnoziegumā, tiek uzskatīts par nevainīgu, kamēr viņa vaina netiek pierādīta saskaņā ar likumu.
  22. Ikvienam, kas tiek apsūdzēts kriminālnoziegumā, ir sekojošas minimālās tiesības:a. tikt nekavējoties informētam, viņam saprotamā valodā un detalizēti, par viņam izvirzītās apsūdzības raksturu un iemeslu;b. uz attiecīgu laiku un līdzekļiem, lai sagatavotu savu aizstāvību;c. aizstāvēt sevi pašam vai ar paša izvēlētu juridisku palīdzību, vai, ja trūkst līdzekļu, lai algotu šo juridisko palīdzību, saņemt to par velti, ja to prasa justīcijas intereses;d. nopratināt vai būt nopratinājušam apsūdzības lieciniekus un pieprasīt aizstāvības liecinieku klātbūtni un nopratināšanu tajos pašos apstākļos kā apsūdzības lieciniekus;e. uz bezmaksas tulka pakalpojumiem, ja viņš nesaprot tiesā lietoto valodu vai nerunā tajā.
  23. pants
  24. Nevienu nedrīkst apsūdzēt kriminālnoziegumā tāda nodarījuma vai nolaidības dēļ, kas, saskaņā ar izdarīšanas brīdī spēkā bijušo valsts iekšējo likumdošanu vai starptautiskajām tiesībām, nebija kriminālnoziegums. Tāpat nedrīkst piespriest smagāku sodu nekā tas, kas bija jāpiemēro kriminālnozieguma izdarīšanas brīdī.
  25. Šis pants neaizliedz nodot tiesai un sodīt jebkuru personu par jebkuru nodarījumu vai nolaidību, kas izdarīšanas brīdī tika uzskatīta par kriminālnoziegumu saskaņā ar vispārējiem civilizētās valstīs atzītajiem tiesību principiem.

  27. Ikvienam ir tiesības uz savas privātās un ģimenes dzīves, dzīvokļa un korespondences neaizskaramību.
  28. Sabiedriskās institūcijas nedrīkst traucēt nevienam baudīt šīs tiesības, izņemot gadījumos, kas paredzēti likumā un ir nepieciešami demokrātiskā sabiedrībā, lai aizstāvētu valsts drošības, sabiedriskās kārtības vai valsts labklājības intereses, lai nepieļautu nekārtības vai noziegumus, lai aizsargātu veselību vai morāli, vai lai aizstāvētu citu tiesības un brīvības.

Ikvienam cilvēkam ir tiesības uz domu, apziņas un reliģijas brīvību; šīs tiesības ietver arī brīvību mainīt savu reliģisko pārliecību vai ticību un nodoties savai reliģijai vai ticībai, kā vienatnē tā kopā ar citiem, piekopjot kultu, izpildot reliģiskas vai rituālas ceremonijas un sludinot mācību.

Brīvība nodoties savai reliģijai vai ticībai var tikt ierobežota tikai likumā paredzētajā kārtībā tai apmērā, kas ir nepieciešams demokrātiskā sabiedrībā, lai nodrošinātu sabiedrisko drošību, saglabātu sabiedrisko kārtību, aizsargātu veselību vai morāli, vai aizsargātu citu cilvēku tiesības un brīvības.
  32. pants
  33. Ikvienam ir tiesības brīvi paust savus uzskatus. Šīs tiesības ietver uzskatu brīvību un tiesības netraucēti saņemt un izplatīt informāciju un idejas bez iejaukšanās no sabiedrisko institūciju puses un neatkarīgi no valstu robežām. Šis pants neapstrīd Valstu tiesības pieprasīt radioraidījumu, televīzijas raidījumu un kino demonstrēšanas licencēšanu.
  34. Tā kā šo brīvību īstenošana ir saistīta ar pienākumiem un atbildību, tā var tikt pakļauta tādām formalitātēm, nosacījumiem, ierobežojumiem vai sodiem, kas paredzēti likumā un nepieciešami demokrātiskā sabiedrībā, lai aizsargātu valsts drošības, teritoriālās vienotības vai sabiedriskās drošības intereses, nepieļautu nekārtības vai noziegumus, aizsargātu veselību vai morāli, aizsargātu citu cilvēku reputāciju vai tiesības, nepieļautu konfidenciālas informācijas izpaušanu vai lai saglabātu tiesas autoritāti un objektivitāti.
  35. pants
  36. Jebkuram cilvēkam ir tiesības uz miermīlīgu pulcēšanās un biedrošanās brīvību, ieskaitot tiesības veidot arodbiedrības un iestāties tajās, lai aizstāvētu savas intereses.
  37. Šīs tiesību izmantošanu nedrīkst pakļaut nekādiem ierobežojumiem, izņemot tiem, kas noteikti ar likumu un ir nepieciešami demokrātiskā sabiedrībā, lai aizstāvētu valsts vai sabiedrības drošības intereses, nepieļautu nekārtības vai noziegumus, aizsargātu veselību vai morāli, vai citu cilvēku tiesības un brīvības. Šis pants nekavē noteikt likumīgus ierobežojumus šo tiesību izmantošanā personām, kas ir bruņoto spēku, policijas vai valsts pārvaldes sastāvā.
  38. pantsPilngadību sasniegušiem vīriešiem un sievietēm ir tiesības stāties laulībā un dibināt ģimeni saskaņā ar valsts iekšējo likumdošanu, kas nosaka šo tiesību izmantošanas kārtību.
  39. pantsIkvienam, kura tiesības un brīvības, kas noteiktas šajā Konvencijā, tiek pārkāptas, ir efektīvas aizsardzības nodrošinājums valsts institūcijās, neskatoties uz to, ka pārkāpumu ir izdarījušas personas, pildot dienesta pienākumus.
  40. pantsŠajā Konvencijā minēto tiesību un brīvību īstenošana tiek nodrošināta bez jebkādas diskriminācijas — neatkarīgi no dzimuma, rases, ādas krāsas, valodas, reliģijas, politiskajiem vai citiem uzskatiem, nacionālās vai sociālās izcelsmes, saistības ar kādu nacionālo minoritāti, mantiskā stāvokļa, kārtas vai cita stāvokļa.
  41. pants
  42. Kara vai kāda cita ārkārtēja sabiedriska stāvokļa gadījumā, kas apdraud nācijas dzīvi, jebkura Augstā Līgumslēdzēja Puse var veikt pasākumus, kas atkāpjas no saistībām, ko tā uzņēmusies šīs Konvencijas ietvaros, tai apjomā, ko neizbēgami prasa situācijas ārkārtas raksturs, ar noteikumu, ka šie pasākumi nav pretrunā ar citām tās saistībām, ko nosaka starptautiskās tiesības.
  43. Šī nosacījuma ietvaros nedrīkst būt atkāpju no Konvencijas
  44. panta nosacījumiem, izņemot attiecībā uz nāves gadījumiem likumīgas kara darbības rezultātā, vai 3.,
  45. (
  46. apakšpunkta) un
  47. panta nosacījumi.
  48. Jebkura Augstā Līgumslēdzēja Puse, kas piešķir sev šīs atkāpšanās tiesības, pilnībā informēs Eiropas Padomes Ģenerālsekretāru par veiktajiem pasākumiem un iemesliem to veikšanai. Tās arī informēs Eiropas Padomes Ģenerālsekretāru par šo pasākumu izbeigšanu un atgriešanos pie šīs Konvencijas nosacījumu pilnīgas ievērošanas.
  49. pantsNekas no 10.,
  50. un
  51. pantā minētā nevar tikt uzskatīts par kavēkli Augstajām Līgumslēdzējām Pusēm, lai noteiktu ierobežojumus ārvalstnieku politiskajām aktivitātēm.
  52. pantsNekas no šajā Konvencijā minētā nevar tikt iztulkots kā jebkādas valsts, grupas vai personas jebkādas tiesības iesaistīties jebkurā darbībā vai veikt jebkuru darbību, kuras mērķis ir likvidēt jebkuras no šeit minētajām tiesībām un brīvībām vai ierobežot tās lielākā mērā nekā tas noteikts šajā Konvencijā.
  53. pantsIerobežojumi, kurus šī Konvencija pieļauj attiecībā uz minētajām tiesībām un brīvībām, netiks pielietoti citiem mērķiem kā vien tiem, kam tie ir paredzēti.II SADAĻA
  54. pantsLai nodrošinātu saistību ievērošanu, kuras Augstās Līgumslēdzējas Puses uzņēmušās šīs Konvencijas ietvaros, tiks nodibināti:a. Eiropas Cilvēka tiesību komisija, turpmāk saukta "Komisija";b. Eiropas Cilvēka tiesību tiesa, turpmāk saukta "Tiesa".III SADAĻA
  55. pants
  56. Komisijas locekļu skaits atbildīs Augsto Līgumslēdzēju Pušu skaitam. Divi Komisijas locekļi nevar būt vienas un tās pašas valsts pilsoņi.
  57. Komisijas apspriedes notiks plenārsēžu veidā. Taču tā var nodibināt Palātas, katru ar vismaz septiņiem locekļiem. Palātas izskatīs petīcijas, kas iesniegtas saskaņā ar šīs Konvencijas
  58. pantu, kuras var izskatīt uz precedenta tiesību pamata, vai kuras neizraisa nopietnas problēmas attiecībā uz šīs Konvencijas nosacījumu tulkojumu vai pielietojumu. Izņemot šo ierobežojumu un šī panta
  59. apakšpunktā minētos nosacījumus, Palātām būs visas tās pašas pilnvaras, ko Komisijai piešķir šī Konvencija.Komisijas loceklim, kurš ievēlēts no tās Augstās Līgumslēdzējas Puses, pret kuru ir iesniegta petīcija, ir tiesības piedalīties tās Palātas darbā, kurai uzticēts izskatīt šo petīciju.
  60. Komisija var dibināt komitejas, ar vismaz trim locekļiem katrā, kuras ir pilnvarotas, nobalsojot vienbalsīgi, paziņot par nepieņemamu vai izslēgt no izskatāmo petīciju saraksta petīciju, kura iesniegta, balstoties uz
  61. pantu, ja šādu lēmumu var pieņemt bez turpmākas lietas izskatīšanas.
  62. Palāta vai komiteja var jebkurā laikā nodot lietas izskatīšanu Komisijas plenārsēdei, kura arī var nodot izskatīšanai jebkuru tai iesniegto petīciju kādai no Palātām vai komitejām.
  63. Vienīgi Komisijas plenārsēde ir pilnvarota:a. izskatīt iesniegumus, kas iesniegti saskaņā ar
  64. pantu;b. iesniegt lietu izskatīšanai Tiesā saskaņā ar
  65. panta a. apakšpunktu;c. sastādīt procedūras noteikumus saskaņā ar
  66. pantu.
  67. pants
  68. Komisijas locekļus ievēl Ministru Komiteja ar absolūtu balsu vairākumu no kandidātu saraksta, ko sastādījis Konsultatīvās Asamblejas birojs; katra Augsto Līgumslēdzēju Pušu pārstāvju grupa Konsultatīvajā Asamblejā izvirza trīs kandidātus, no kuriem vismaz divi ir šo valstu pilsoņi.
  69. Ciktāl tā ir piemērojama, šī pati procedūra tiek ievērota, lai papildinātu Komisijas sastāvu tajā gadījumā, ja šai Konvencijai pievienojas citas valstis vai lai aizpildītu radušās vakances.
  70. Kandidātiem jābūt morāli izturētiem un jābūt vai nu attiecīgi kvalificētiem, lai ieņemtu augstu amatu tieslietu sfērā, vai arī atzītiem speciālistiem nacionālo vai starptautisko tiesību jomā.
  71. pants
  72. Komisijas locekļus ievēl uz sešiem gadiem. Viņi var tikt ievēlēti uz jaunu termiņu. Taču septiņiem pirmajās vēlēšanas ievēlētajiem locekļiem pilnvaru termiņš izbeidzas pēc trim gadiem.
  73. Tos locekļus, kuru termiņš izbeidzas sākotnējā trīs gadu perioda beigās, nosaka Eiropas Padomes Ģenerālsekretārs ar izlozes palīdzību tūlīt pēc pirmo vēlēšanu beigām.
  74. Lai iespēju robežās nodrošinātu to, ka ik pēc trim gadiem uz pusi tiek atjaunots Komisijas locekļu sastāvs, Ministru Komiteja var nolemt, vēl pirms vēlēšanu sarīkošanas, ka viena vai vairāku ievēlamo locekļu termiņš būs cits nekā seši gadi, taču ne lielāks par deviņiem un ne mazāks par trim gadiem.
  75. Gadījumos, kas attiecas uz vairāk nekā vienu pilnvaru termiņu un kur Ministru Komiteja piemēro iepriekšējo apakšpunktu, pilnvaru termiņu piešķir Ģenerālsekretārs ar izlozes palīdzību tūlīt pēc vēlēšanu beigām.
  76. Komisijas loceklis, kurš ir ievēlēts, lai aizstātu locekli, kura pilnvaru termiņš nav beidzies, saglabā pilnvaras līdz sava priekšgājēja termiņa beigām.
  77. Komisijas locekļi atrodas šajā postenī līdz tam laikam, kamēr tie tiek aizstāti ar citiem locekļiem. Pēc tam, kad tie tiek aizstāti, viņi turpina nodarboties ar tām lietām, kuras tiem jau bija iesniegtas izskatīšanai.
  78. pantsKomisijas locekļi piedalās Komisijas sēdēs, pārstāvot paši sevi. Sava termiņa laikā tie nevar ieņemt nekādu amatu, kas nav savienojams ar viņu kā Komisijas locekļu neatkarību un objektivitāti vai prasībām, ko izvirza šis postenis.
  79. pantsJebkura Augstā Līgumslēdzēja Puse var caur Eiropas Padomes Ģenerālsekretāru iesniegt Komisijai izskatīšanai apsūdzību jebkurā šīs Konvencijas nosacījumu pārkāpumā, ko izdarījusi cita Augstā Līgumslēdzēja Puse.
  80. pants
  81. Komisija var saņemt Eiropas Padomes Ģenerālsekretāram adresētas petīcijas no jebkuras personas, sabiedriskas organizācijas vai indivīdu grupas, kas apgalvo, ka ir cietuši no šajā Konvencijā minēto tiesību pārkāpumiem, kurus izdarījusi kāda no Augstajām Līgumslēdzējām Pusēm, ar nosacījumu, ka Augstā Līgumslēdzēja Puse, pret kuru iesniegta šī sūdzība, ir deklarējusi, ka tā atzīst Komisijas pilnvaras saņemt šādas petīcijas. Tās Augstās Līgumslēdzējas Puses, kuras ir izdarījušas šādu paziņojumu, apņemas nekādā veidā nekavēt efektīvu šo tiesību īstenošanu.
  82. Šādi paziņojumi var tikt izdarīti uz noteiktu laika periodu.
  83. Šie paziņojumi tiek nodoti glabāšanā Eiropas Padomes Ģenerālsekretāram, kurš izsūta to kopijas Augstajām Līgumslēdzējām Pusēm un publicē tos.
  84. Komisija īstenos šajā pantā minētās pilnvaras tikai tad, ja vismaz sešas Augstās Līgumslēdzējas Puses būs saistījušas sevi ar paziņojumiem kārtībā, kas minēta iepriekšējos apakšpunktos.
  85. pantsKomisija izskata lietu tikai tad, ja ir izsmeltas visas iekšējās tiesiskās aizsardzības iespējas, saskaņā ar vispāratzītām starptautisko tiesību normām un sešu mēnešu laikā, skaitot no datuma, kad ticis pieņemts pēdējais lēmums.
  86. pants
  87. Komisija neizskatīs nevienu petīciju, kas iesniegta saskaņā ar
  88. pantu, kura:a. ir anonīma vaib. pēc savas būtības ir tā pati lieta, kas jau tikusi izskatīta Komisijā vai jau ir bijusi iesniegta citai starptautiskai izskatīšanas vai konflikta atrisināšanas procedūrai un ja tā nesatur būtiski jaunu informāciju.
  89. Komisija uzskata par nepieņemamu jebkuru petīciju, kas iesniegta saskaņā ar
  90. pantu, kuru tā uzskata par nesavienojamu ar šīs Konvencijas nosacījumiem, izteikti nepamatotu vai arī par ļaunprātīgu petīciju iesniegšanas tiesību izmantošanu.
  91. Komisija noraida jebkuru petīciju, kas tai iesniegta, kuru tā uzskata par nepieņemamu saskaņā ar
  92. panta nosacījumiem.
  93. pants
  94. Ja Komisija pieņem tai iesniegto petīciju:a. faktu apstiprināšanas nolūkā tā kopīgi ar pušu pārstāvjiem uzsāk petīcijas izskatīšanu un, ja nepieciešams, izmeklēšanu, kuras efektivitātes labad, pēc viedokļu apmaiņas ar Komisiju, attiecīgās valstis nodrošina visus nepieciešamos līdzekļus;b. tajā pašā laikā Komisija nodod sevi iesaistīto pušu rīcībā, ar nolūku nodrošināt miermīlīgu problēmas atrisinājumu, balstoties uz šajā Konvencijā minēto cilvēka tiesību ievērošanu.
  95. Ja Komisijai izdodas rast miermīlīgu problēmas risinājumu, tā sastāda ziņojumu, kas tiek nosūtīts attiecīgajām Valstīm, Ministru Komitejai un Eiropas Padomes Ģenerālsekretāram publicēšanai. Šis ziņojums aprobežojas ar īsu faktu un sasniegtā atrisinājuma izklāstu.
  96. pantsPēc tam, kad tā ir pieņēmusi petīciju, kas iesniegta saskaņā ar
  97. pantu, Komisija var tomēr ar divu trešdaļu balsu vairākumu nolemt noraidīt minēto petīciju, ja tās izskatīšanas gaitā tā nosaka, ka pastāv kāds no
  98. pantā minētajiem noraidīšanas iemesliem.Šajā gadījumā lēmumu dara zināmu attiecīgajām pusēm.
  99. pants
  100. Jebkurā procesa stadijā Komisija var nolemt izsvītrot kādu petīciju no izskatāmo lietu saraksta, ja apstākļi ļauj konstatēt, ka:a. petīcijas iesniedzējs negatavojas uzturēt apsūdzību vaib. jautājums ir atrisināts, vaic. jebkura cita Komisijas noteikta iemesla dēļ neattaisnojas turpināt izskatīt minēto petīciju.Tomēr Komisija turpina izskatīt petīciju, ja to prasa šajā Konvencijā minēto cilvēka tiesību ievērošana.
  101. Ja Komisija nolemj izslēgt kādu tās pieņemtu petīciju no izskatāmo lietu saraksta, tā sastāda ziņojumu, kurā ir izklāstīti fakti un lēmums izslēgt petīciju, kā arī šī lēmuma pieņemšanas iemesli. Ziņojumu nosūta iesaistītajām pusēm, ka arī Ministru Komitejai informācijai. Komisija var to publicēt.
  102. Komisija var nolemt atjaunot kādu petīciju izskatāmo lietu sarakstā, ja tā uzskata, ka apstākļi attaisno šādu rīcību.
  103. pants
  104. Ja kādas petīcijas izskatīšana nav notikusi saskaņā ar
  105. pantu (
  106. apakšpunktu),
  107. vai
  108. pantu, Komisija sastāda ziņojumu par faktiem un dod savu vērtējumu par to, vai konstatētie fakti satur attiecīgās valsts ar šo Konvenciju noteikto saistību pārkāpumu. Ziņojumā var tikt atspoguļoti Komisijas locekļu individuālie viedokļi par attiecīgo jautājumu.
  109. Ziņojumu iesniedz Ministru Komitejai. Tas tiek nosūtīts arī attiecīgajām valstīm, kurām nav tiesību to publicēt.
  110. Iesniedzot ziņojumu Ministru Komitejai, Komisija var izteikt priekšlikumus, kurus tā uzskata par pieņemamiem.
  111. pants
  112. Ja jautājums netiek iesniegts Tiesai saskaņā ar šīs Konvencijas
  113. pantu trīs mēnešu laikā pēc dienas, kad ziņojums tika iesniegts Ministru Komitejai, Ministru Komiteja ar pilntiesīgo locekļu divu trešdaļu balsu vairākumu nolemj, vai Konvencija ir tikusi pārkāpta.
  114. Pozitīva lēmuma gadījumā Ministru Komiteja nosaka laika periodu, kurā attiecīgajai Augstajai Līgumslēdzējai Pusei jāveic Ministru Komitejas lēmumā noteiktie pasākumi.
  115. Ja attiecīgā Augstā Līgumslēdzēja Puse paredzētajā laikā nav veikusi pienācīgus pasākumus, Ministru Komiteja ar
  116. apakšpunktā minēto vairākumu nolemj, kā tiks īstenots tās sākotnējais lēmums, un publicē ziņojumu.
  117. Augstās Līgumslēdzējas Puses apņemas uzskatīt par tām saistošu jebkuru Ministru Komitejas lēmumu, kas var tikt pieņemts, piemērojot iepriekšējos apakšpunktos minētos nosacījumus.
  118. pantsKomisijas sēdes ir slēgtas.
  119. pantsIevērojot
  120. panta
  121. apakšpunkta un
  122. panta nosacījumus, Komisija pieņem lēmumus ar klātesošo un balsojošo locekļu balsu vairākumu.
  123. pantsKomisija notur sēdes, vadoties pēc apstākļiem. Sēdes sasauc Eiropas Padomes Ģenerālsekretārs.
  124. pantsKomisija pati sastāda savu reglamentu.
  125. pantsKomisijas sekretariātu nodrošina Eiropas Padomes Ģenerālsekretārs.IV SADAĻA
  126. pantsEiropas Cilvēka Tiesību tiesa sastāv no tiesnešiem, kuru skaits atbilst Eiropas Padomes dalībvalstu skaitam. Divi tiesneši nevar būt vienas un tās pašas valsts pilsoņi.

  128. Tiesas locekļus ievēl Konsultatīvā Asambleja ar balsu vairākumu no kandidātu saraksta, kurus izvirzījušas Eiropas Padomes dalībvalstis; katra dalībvalsts izvirza trīs kandidātus, no kuriem vismaz divi ir tās pilsoņi.
  129. Iespēju robežās šo pašu procedūru ievēro papildinot Tiesas sastāvu jaunu Eiropas Padomes dalībvalstu uzņemšanas gadījumā, kā arī aizpildot radušās vakances.
  130. Kandidātiem jābūt morāli izturētiem un jābūt vai nu attiecīgi kvalificētiem, lai ieņemtu augstu amatu tieslietu sfērā, vai arī autoritatīviem juriskonsultiem.
  131. pants
  132. Tiesas locekļus ievēl uz deviņiem gadiem. Viņi var tikt ievēlēti atkārtoti. Taču četru pirmajās vēlēšanās ievēlēto locekļu termiņš beidzas pēc trim gadiem un vēl citu četru — pēc sešiem gadiem.
  133. Tos locekļus, kuru pilnvaru termiņš beidzas sākotnējā trīs un sešu gadu beigās, Ģenerālsekretārs izvēlas ar izlozes palīdzību tūlīt pēc pirmo vēlēšanu beigām.
  134. Lai iespēju robežās ik pēc trim gadiem nodrošinātu Tiesas sastāva atjaunošanu par vienu trešdaļu, pirms nākošo vēlēšanu sarīkošanas Konsultatīvā Asambleja var nolemt, ka viena vai vairāku jaunievēlamo locekļu pilnvaru termiņš būs cits nekā deviņi gadi, taču ne lielāks par divpadsmit un ne mazāks par sešiem gadiem.
  135. Gadījumos, kas attiecas uz vairāk nekā vienu pilnvaru termiņu un Konsultatīvā Asambleja piemēro iepriekšējā apakšpunkta nosacījumus, Ģenerālsekretārs piešķir pilnvaru termiņus ar izlozes palīdzību tūlīt pēc vēlēšanu beigām.
  136. Tiesas loceklis, kas ievēlēts, lai aizvietotu kādu citu locekli, kura pilnvaru termiņš vēl nav beidzies, saglabā pilnvaras līdz sava priekšgājēja termiņa beigām.
  137. Tiesas locekļi atrodas šai postenī līdz tam laikam, kamēr tie tiek aizstāti ar citiem locekļiem. Pēc tam, kad tie tiek aizstāti, viņi turpina nodarboties ar tām lietām, kuras tiem jau bija iesniegtas izskatīšanai.
  138. Tiesas locekļi piedalās Tiesas sēdēs, pārstāvot paši sevi. Sava termiņa laikā tie nevar ieņemt nekādu amatu, kas nav savienojams ar viņu kā Tiesas locekļu neatkarību un objektivitāti vai prasībām, ko izvirza šis postenis.
  139. pantsTiesa ievēl savu prezidentu un vienu vai divus viceprezidentus uz trim gadiem. Viņi var tikt ievēlēti atkārtoti.
  140. pantsTiesas locekļi par katru dienu, ko tie pavada, pildot savus pienākumus, saņem atalgojumu, kuru nosaka Ministru Komiteja.
  141. pantsLai izskatītu ikvienu iesniegto lietu, Tiesa izveido Palātu, kas sastāv no deviņiem tiesnešiem. Tajā kā ex

ficio Palātas loceklis piedalās tiesnesis, kurš ir ar šo lietu saistītās dalībvalsts pilsonis, vai, ja tāda nav, attiecīgā valsts izvēlas personu, kura piedalās sēdēs ar tiesneša pilnvarām; pārējo tiesnešu vārdus pirms lietas izskatīšanas sākuma izvēlas prezidents ar izlozes palīdzību.

  1. pantsTikai Augstajām Līgumslēdzējām Pusēm un Komisijai ir tiesības iesniegt lietu izskatīšanai Tiesā.
  2. pantsTiesas jurisdikcija attiecas uz visām lietām, kas saistītas ar šīs Konvencijas tulkojumu un pielietojumu, Augstajām Līgumslēdzējām Pusēm vai Komisijai atsaucoties uz to saskaņā ar
  3. pantu.
  4. pants
  5. Jebkura no Augstajām Līgumslēdzējām Pusēm var jebkurā laikā deklarēt, ka tā atzīst Tiesas jurisdikciju visos jautājumos, kas attiecas uz šīs Konvencijas tulkojumu un pielietojumu, par obligātu ipso facto un bez īpašas vienošanās par to.
  6. Minētās deklarācijas var būt bez nosacījumiem, vai arī vairākas vai noteiktas citas Austās Līgumslēdzējas Puses var tās izdarīt uz savstarpējības pamata, vai arī uz zināmu laika periodu.
  7. Šīs deklarācijas tiek nodotas glabāšanā Eiropas Padomes Ģenerālsekretāram, kurš to kopijas izsūta Augstajām Līgumslēdzējām Pusēm.
  8. pantsTiesa var izskatīt kādu lietu vienīgi tad, kad Komisija ir atzinusi, ka visas pūles mierīgai noregulēšanai ir bijušas veltas, un Tiesai tas jāizdara
  9. pantā minēto trīs mēnešu laikā.
  10. pantsAr nosacījumu, ka Augstā Līgumslēdzēja Puse, ja tāda ir tikai viena, vai Augstās Līgumslēdzējas Puses, ja tādas ir vairākas, kuras pakļaujas obligātajai Tiesas jurisdikcijai vai, šim nosacījumam nepastāvot, ar attiecīgās Augstās Līgumslēdzējas Puses, ja tāda ir tikai viena, vai Augsto Līgumslēdzēju Pušu, ja tādas ir vairākas, piekrišanu, lietas izskatīšanu tiesā var ierosināt:a. Komisija;b. Augstā Līgumslēdzēja Puse, kuras pilsonis pretendē uz cietušā statusu;c. Augstā Līgumslēdzēja Puse, kura ir iesniegusi lietu Komisijai;d. Augstā Līgumslēdzēja Puse, pret kuru ir iesniegta sūdzība.
  11. pantsStrīdus gadījumā par to, vai lieta ir Tiesas jurisdikcijā, tas tiek atrisināts ar Tiesas lēmumu.
  12. pantsJa Tiesa konstatē, ka lēmums vai pasākumi, ko pieņēmusi vai veikusi kāda Augstās Līgumslēdzējas Puses juridiska vai kāda cita institūcija pilnībā vai daļēji ir pretrunā ar saistībām, kas izriet no šīs Konvencijas, un ja attiecīgās Puses iekšējā likumdošana pieļauj tikai daļēju šī lēmuma vai veikto pasākumu seku labošanu, ar Tiesas lēmumu cietušajai pusei, ja nepieciešams, tiks sniegta taisnīga kompensācija.
  13. pants
  14. Tiesas spriedumam tiek dots pamatojums.
  15. Ja spriedums vai nu pilnībā, vai daļēji neatspoguļo vienbalsīgu tiesnešu viedokli, ikvienam tiesnesim ir tiesības izteikt atsevišķu viedokli.
  16. pantsTiesas spriedums ir galīgs.
  17. pantsAugstās Līgumslēdzējas Puses apņemas ievērot Tiesas lēmumu ikvienā lietā, kurā tās ir iesaistītas.
  18. pantsTiesas spriedums tiek nosūtīts Ministru Komitejai, kura pārrauga tā īstenošanu.
  19. pantsTiesa izstrādā savus noteikumus un nosaka savu reglamentu.
  20. pants
  21. Pirmās Tiesas locekļu vēlēšanas notiek pēc tam, kad
  22. pantā minēto Augsto Līgumslēdzēju Pušu deklarāciju skaits ir sasniedzis astoņus.
  23. Pirms šīm vēlēšanām Tiesai nevar iesniegt nevienu lietu.V SADAĻA
  24. pantsSaņemot pieprasījumu no Eiropas Padomes Ģenerālsekretāra, jebkura Augstā Līgumslēdzēja Puse sniedz paskaidrojumus par veidu, kādā tās iekšējā likumdošana nodrošina efektīvu jebkura šīs Konvencijas nosacījuma īstenošanu.
  25. pantsKomisijas un Tiesas izdevumus sedz Eiropas Padome.
  26. pantsSavu funkciju pildīšanas laikā Komisijas un Tiesas locekļiem ir tiesības uz privilēģijām un imunitātēm, kas minētas Eiropas Padomes Statūtu
  27. pantā un saskaņā ar Statūtiem noslēgtajos līgumos.
  28. pantsNeko šajā Konvencijā nedrīkst iztulkot kā ierobežojumu vai atkāpšanos no jebkurām cilvēka tiesībām un pamatbrīvībām, kas var tikt nodrošinātas saskaņā ar jebkuras Augstās Līgumslēdzējas Puses likumiem vai jebkuru citu līgumu, ko tā ir parakstījusi.
  29. pantsNekas šajā Konvencijā neapstrīd Ministru Komitejas pilnvaras, ko tai piešķir Eiropas Padomes Statūti.
  30. pantsAugstās Līgumslēdzējas Puses vienojas, ka, izņemot atsevišķi par to vienojoties, tās neizmantos līgumus, konvencijas vai deklarācijas, kuras ir spēkā to starpā, lai petīcijas veidā iesniegtu izskatīšanai strīdu, kas radies, tulkojot vai pielietojot šo Konvenciju, citām konfliktu risināšanas instancēm, nekā tām, kas ir paredzētas šajā Konvencijā.
  31. pants
  32. Ikviena valsts, vai nu šīs Konvencijas ratificēšanas laikā, vai pēc tās ratificēšanas, var paziņot, nosūtot rakstveida paziņojumu Eiropas Padomes Ģenerālsekretāram, ka šī Konvencija attieksies uz visām vai jebkuru no tās teritorijām, par kuru starptautiskajām attiecībām tā ir atbildīga.
  33. Konvencija attieksies uz teritoriju vai teritorijām, kas minētas paziņojumā, sākot ar trīspadsmito dienu pēc tās dienas, kad Eiropas Padomes Ģenerālsekretārs saņems šo paziņojumu.
  34. Taču minētajās teritorijās šīs Konvencijas nosacījumi tiek pielietoti, ņemot vērā vietējās prasības.
  35. Ikviena valsts, kas ir nosūtījusi paziņojumu saskaņā ar šī panta
  36. apakšpunktu, jebkurā laikā pēc tam var izdarīt paziņojumu par vienu vai vairākām teritorijām, uz kurām attiecas paziņojums, ka tā atzīst Komisijas kompetenci saņemt petīcijas no indivīdiem, sabiedriskajām organizācijām vai indivīdu grupām saskaņā ar šīs Konvencijas
  37. pantu.
  38. pants
  39. Parakstot šo Konvenciju vai nosūtot tās ratifikācijas instrumentu, ikvienai valstij ir tiesības uz atrunu attiecībā uz jebkuru atsevišķu Konvencijas nosacījumu tiktāl, cik kāds no tās teritorijā spēkā esošiem likumiem nav saskaņā ar šo nosacījumu. Šis pants nosaka, ka vispārēja rakstura atrunas nav pieļaujamas.
  40. Jebkurai saskaņā ar šo pantu izdarītai atrunai ir jāsatur īss attiecīgā likuma izklāsts.
  41. pants
  42. Augstā Līgumslēdzēja Puse var denonsēt šo Konvenciju tikai pēc pieciem gadiem kopš dienas, kad tā pievienojās šai Konvencijai, paziņojot par to sešus mēnešus iepriekš ar rakstisku paziņojumu, kas adresēts Eiropas Padomes Ģenerālsekretāram, kurš par to informēs pārējās Augstās Līgumslēdzējas Puses.
  43. Šāda denonsēšana neatbrīvo attiecīgo Augsto Līgumslēdzēju Pusi no tās saistībām šīs Konvencijas ietvaros attiecībā uz jebkuru rīcību, kas varētu tikt uzskatīta par šo saistību pārkāpumu, ko tā varētu būt izdarījusi pirms denonsēšanas spēkā stāšanās brīža.
  44. Ikviena Augstā Līgumslēdzēja Puse, kas pārtrauc būt Eiropas Padomes locekle, zaudē savas dalībvalsts statusu attiecībā uz šo Konvenciju saskaņā ar tiem pašiem nosacījumiem.
  45. Konvencija var tikt denonsēta saskaņā ar iepriekšējo apakšpunktu nosacījumiem attiecībā uz jebkuru teritoriju, par kuru saskaņā ar
  46. panta nosacījumiem tika paziņots, ka šī Konvencija to aptver.
  47. pants
  48. Šī Konvencija ir pieejama parakstīšanai Eiropas Padomes dalībvalstīm. Tā jāratificē. Ratifikācijas instrumenti tiks nodoti glabāšanā Eiropas Padomes Ģenerālsekretāram.
  49. Šī Konvencija stāsies spēkā pēc tam, kad glabāšanā būs nodoti desmit ratifikācijas instrumenti.
  50. Attiecībā uz ikvienu šai Konvencijai pievienojušos valsti, kas to ratificē vēlāk, Konvencija stājas spēkā ar to dienu, kad šīs valsts ratifikācijas instruments tiek nodots glabāšanā.
  51. Eiropas Padomes Ģenerālsekretārs paziņo visām Eiropas Padomes dalībvalstīm par Konvencijas stāšanos spēkā, Augsto Līgumslēdzēju Pušu vārdus, kas ir to ratificējušas, un visiem ratifikācijas instrumentiem, kas tiek nodoti glabāšanā vēlāk.Parakstīta

  53. novembrī Romā, angļu un franču valodā, kur abi teksti ir vienādi autentiski, vienā eksemplārā, kas glabājas Eiropas Padomes arhīvā. Ģenerālsekretārs izsūtīs apstiprinātas kopijas ikvienai šo Konvenciju parakstījušajai valstij.   55. decembrī Romā parakstītās Cilvēka tiesību un pamatbrīvību aizsardzības konvencijas (turpmāk saukta "Konvencija") I sadaļā,Vienojās par sekojošo:
  56. pantsJebkurai fiziskai vai juridiskai personai ir tiesības uz īpašumu. Nevienam nedrīkst atņemt viņa īpašumu, izņemot, ja tas notiek sabiedrības interesēs un apstākļos, kas noteikti ar likumu un atbilst vispārējiem starptautisko tiesību principiem.Minētie nosacījumi nekādā veidā nedrīkst ierobežot valsts tiesības izdot tādus likumus, kādus tā uzskata par nepieciešamiem, lai kontrolētu īpašuma izmantošanu saskaņā ar vispārējām interesēm vai lai nodrošinātu nodokļu vai citu maksājumu vai sodu samaksu.
  57. pantsNevienam cilvēkam nedrīkst liegt tiesības uz izglītību. Veicot jebkuras funkcijas, kuras tā uzņemas attiecībā uz izglītību un mācībām, valsts ievēro vecāku tiesības nodrošināt tādu izglītību un mācības, kas ir saskaņā ar viņu reliģisko pārliecību un filozofiskajiem uzskatiem.
  58. pantsAugstās Līgumslēdzējas Puses apņemas ik pēc attiecīga laika perioda organizēt brīvas un aizklātas vēlēšanas apstākļos, kas veicina tautas viedokļa brīvu izpausmi, izvēloties likumdevēju varu.
  59. pantsIkviena Augstā Līgumslēdzēja Puse Konvencijas parakstīšanas vai ratifikācijas laikā, vai jebkurā laikā pēc tam nosūtīt Eiropas Padomes Ģenerālsekretāram deklarāciju, kurā norādīts, cik lielā mērā tā apņemas attiecināt šī Protokola nosacījumus uz tām deklarācijā nosauktajām teritorijām, par kuru starptautiskajām attiecībām tā ir atbildīga.Ikviena Augstā Līgumslēdzēja Puse, kas ir nosūtījusi iepriekšminēto deklarāciju, var ik pēc laika nosūtīt nākošās deklarācijas par izmaiņām iepriekšējo deklarāciju nosacījumos vai par to, ka tiek izbeigta šī Protokola nosacījumu attiecināšana uz kādu no tās teritorijām.Saskaņā ar šo pantu izdarītā deklarācija tiks uzskatīta kā izdarīta saskaņā ar Konvencijas
  60. panta
  61. apakšpunktu.
  62. pantsAugsto Līgumslēdzēju Pušu starpā šī Protokola 1., 2.,
  63. un
  64. panta nosacījumi tiks uzskatīti par Konvencijas papildus pantiem, visiem Konvencijas nosacījumiem attiecīgi esot spēkā.
  65. pantsŠo Protokolu var parakstīt Eiropas Padomes dalībvalstis, kuras ir parakstījušas Konvenciju; tas tiks ratificēts reizē ar Konvenciju vai pēc tās ratificēšanas. Tas stāsies spēkā pēc tam, kad tiks iesniegti desmit ratifikācijas instrumenti. Attiecībā uz jebkuru pievienojušos valsti, kas ratifikāciju izdarīs pēc tam, Protokols stāsies spēkā tai dienā, kad tiks iesniegti šīs valsts ratif
