Šis likums apstiprina un pieņem 1924. gada Starptautisko konvenciju par dažu konosamenta noteikumu unifikāciju (Hāgas noteikumi), tās 1968. gada protokolu (Visbijas protokols) un 1979. gada protokolu (SDR protokols). Tas nosaka starptautiskus noteikumus par pārvadātāja atbildību un tiesībām attiecībā uz preču pārvadāšanu ar jūras transportu, izmantojot konosamentus.

Galvenie punkti
- Pārvadātājam pirms un ceļojuma sākumā ir pienākums nodrošināt kuģa jūras spēju, pareizu apkalpi, aprīkojumu un apgādi, kā arī kravas telpu piemērotību preču pārvadāšanai.
- Pārvadātājs ir atbildīgs par preču pienācīgu un rūpīgu iekraušanu, apstrādi, izvietošanu, pārvadāšanu, glabāšanu, aprūpi un izkraušanu.

- Pārvadātājs nav atbildīgs par zaudējumiem vai bojājumiem, kas pārsniedz 100 sterliņu mārciņas par iepakojumu vai vienību, ja vien preču raksturs un vērtība nav deklarēta un norādīta konosamentā.
- Pretenzijas par zaudējumiem vai bojājumiem jāiesniedz rakstiski pārvadātājam vai tā aģentam izkraušanas ostā pirms vai preču izņemšanas brīdī; ja zaudējumi nav acīmredzami, paziņojums jāiesniedz trīs dienu laikā pēc piegādes.
- Pārvadātājs un kuģis tiek atbrīvoti no jebkādas atbildības par zaudējumiem vai bojājumiem, ja prasība netiek celta viena gada laikā pēc preču piegādes vai datuma, kad preces bija jāpiegādā.

TERNATIONAL CONVENTION FOR THE UNIFICATION OF CERTAIN RULES RELATING TO BILLS OF LADING, SIGNED AT BRUSSELS, AUGUST 25, 1924 Article 1In this convention the following words are employed with the meanings set out below:(a) "Carrier"
cludes the owner of the vessel or the charterer who enters
to a contract of carriage with a shipper.(b) Contract of carriage applies only to contracts of carriage covered by a bill of lading or any similar document of title,
so far as such document relates to the carriage of goods by sea; it also applies to any bill of lading or any similar document as aforesaid issued under or pursuant to a charter party from the moment at which such
strument regulates the relations between a carrier and a holder of the same.(c) "Goods"
cludes goods, wares, merchandise, and articles of every kind whatsoever except live animals and cargo which by the content of carriage is stated u being carried on deck and is so carried.(
- d)"Ship" means any vessel used for the carriage of goods by sea.(
- e)"Carriage of goods" covers the period from the time when goods are loaded on to the time they are discharged from the ship.Article 2Subject to the provisions of Article 6, under every contract of carriage of goods by sea the carrier,
relation to the loading, handling, storage, carriage, custody, care; and discharge of such goods shall be subject to the responsibilities and liabilities, and entitled to the rights and immunities hereinafter set forth.Article 31. The carrier shall be bound before and at the beginning of the voyage to exercise due diligence to:(a) Make the ship seaworthy;(b) Properly man equip, and supply the ship;(c) Make the holds refrigerating and cold chambers, and al1 other parts of the ship
which goods are carried, fit and safe for their reception, carriage, and preservation.
- Subject to the provisions of Article 4, the carrier shall properly and carefully load, handle, stow, carry, keep, care for, and discharge the goods carried.
- After receiving the goods
to his charge, the carrier or the master or agent of the carrier shall, on demand of the shipper, issue to the shipper a bill of loading showing among other things:(a) The leading marks necessary for identification of the goods as the same are furnished
writing by the shipper before the loading of such goods starts, provided such marks are stamped or otherwise shown clearly upon the goods if uncovered, or on the cases or coverings
which such goods are contained,
such a manner as should ordinarily remain legible until the end of the voyage;(b) Either the number of packages or pieces, or the quantity, or weight, as the case may be, as furnished
writing by the shipper,(c) The apparent order and condition of the goods.Provided that no carrier, master, or agent of the carrier shall be bound to state or show
the bill of lading any marks: number, quantity or weight which he has reasonable grounds for suspecting not accurately to represent the goods actually received or which he has had no reasonable means of checking.4. Such a bill of lading shall be prima facie evidence of the receipt by the carrier of the goods as therein described
accordance with paragraph 3 (a), (b) and (c).5. The shipper shall be deemed to have guaranteed to the carrier the accuracy at the time of shipment of the marks, number, quantity, and weight, as furnished by him, and the shipper shall
demnify the carrier against all loss, damages, and expenses arising or resulting from
accuracies

demnity shall
no way limit his responsibility and liability under the contract of carriage to any person other than the shipper.6. Unless notice of loss or damage and the general nature of such loss or damage be given
writing to the carrier or his agent at the port of discharge before or at the time of the removal of the goods
to the custody of the person entitled to delivery thereof under the contract of carriage, such removal shall be prima facie evidence of the delivery by the carrier of the goods as described

writing need not be given if the state of the goods has at the time of their receipt been the subject of joint survey or
spection.
any event the carrier and the ship shall be discharged from all liability
respect of loss or damage unless suit is brought within one year after delivery of the goods or the date when the goods should have been delivered.

After the goods are loaded, the bill of lading to be issued by the carrier, master, or agent of the carrier to the shall, if the shipper so demands, be a "shipped" bill of lading, provided that if the shipper shall have previously taken up any document of title to such goods, he shall surrender the same as against the issue of the "shipped" bill of lading. At the option of the carrier such document of title may be noted at the port of shipment by the carrier, master, or agent with the name or names of the ship or ships upon which the goods have been shipped and the date or dates of shipment, and when so noted, if it shows the particulars mentioned
paragraph 3 of Article 3, it shall for the purpose of this article he deemed to constitute a "shipped" bill of lading.8. Any clause, covenant, or agreement

connection with goods arising from negligence, fault, or failure

which goods are carried fit and safe for their reception, carriage, and preservation

- Whenever loss or damage has resulted from unseaworthiness, the burden of proving the exercise of due diligence shall be on the carrier or other person claiming exemption under this article.
- Neither the carrier nor the ship shall be responsible for loss or damage arising or resulting from:(a) Act, neglect, or default of the master, mariner, pilot, or the servants of the carrier
the navigation or
the management of the ship.(
- b)Fire, unless caused by the actual fault or privity of the carrier.(
- c)Perils, dangers, and accidents of the sea or other navigable waters.(
- d)Act of God.(
- e)Act of war.(
- f)Act of public enemies.(
- g)Arrest or restraint of princes, rulers. or people or seizure under legal process.(
- h)Quarantine restrictions.(
- i)Act or omission of the shipper or owner of the goods, his agent or representative.(
- j)(
- j)Strikes or lock-outs or stoppage or restraint of labour from whatever cause, whether partial or general.(
- k)Riots and civil commotions.(
- l)Saving or attempting to save life or property at sea.(
- m)Wastage
bulk or weight or any other loss or damage arising from
herent defect, quality, or vice of the goods.(n)
sufficiency of packing.(o)
sufficiency or
adequacy of marks.(
- p)Latent defects not discoverable by due diligence.(
- q)Any other cause arising without the actual fault or privity of the carrier, or without the fault or neglect of the agents or servants of the carrier, but the burden of proof shall be on the person claiming the benefit of this exception to show that neither the actual fault or privity of the carrier nor the fault or neglect of the agents of the carrier contributed to the loss or damage.3. The shipper shall not be responsible for loss or damage sustained by the carrier or the ship arising or resulting from any cause without the act, fault, or neglect of the shipper, his agents, or his servants.4. Any deviation
saving or attempting to save life or property at sea or any reasonable deviation shall not be deemed to be an
fringement or breach of this convention or of the contract of carriage, and the carrier shall not be liable for any loss or damage resulting therefrom.5. Neither the carrier nor the ship shall
any event be or become liable for any loss or damage to or
connection with goods
an amount exceeding 100 pounds sterling per package or unit or the equivalent of that sum
other currency, unless the nature and value of such goods have been declared by the shipper before shipment and

any event for loss or damage to, or
connection with, goods if the nature or value thereof has been knowingly mis-sated by the shipper
the bill of lading.6. Goods of an
flammable, explosive, or dangerous nature to the shipment whereof the carrier, master, or agent of the carrier has not consented with knowledge of their nature and character may at any time before discharge be landed at any place or destroyed or rendered
nocuous by the carrier without compensation, and the shipper of such goods shall be liable for all damages and expenses directly or
directly arising out of or resulting from such shipment. If any such goods shipped with such knowledge and consent shall become a danger to the ship or cargo they may
like manner be landed at any place or destroyed or rendered
nocuous by the carrier without liability on the part of the carrier except to general avenge, if any.Article 5A carrier shall be at liberty to surrender
whole or
part all or any of his rights and immunities, or to
crease any of his responsibilities and liabilities under this convention provided such surrender or
crease shall be embodied
the bill of lading issued to the shipper.The provisions of this convention shall not be applicable to charter parties, but if bills of lading are issued
the case of a ship under a charter-party they shall comply with the terms of this convention. Nothing
these rules shall be held to prevent the

a bill of lading of any lawful provision regarding general average.Article 6Notwithstanding the provisions of the preceding articles, a carrier, master, or agent of the carrier and a shipper shall
regard to any particular goods be at liberty to enter

respect of such goods, or concerning his obligation as to seaworthiness so far as this stipulation is not contrary to public policy or concerning the care or diligence of his servants or agents

this case no bill of lading has been or shall be issued and that the terms agreed shall be embodied
a receipt, which shall be a non-negotiable document and shall be marked as such.Any agreement so entered
to shall have full legal effect.Provided that this article shall not apply to ordinary commercial shipments made
the condition of the property to be carried or the circumstances, terms, and conditions under which the carriage is to be performed are such as reasonably to justify a special agreement.Article 7Nothing, herein contained shall prevent a carrier or a shipper from entering
to any agreement stipulation, condition, reservation or exemption as to the responsibility and liability of the carrier or the ship for the loss or damage to, or
connection with the custody and care and handling of goods prior to the loading on, and subsequent to the discharge from the ship on which the goods are carried by sea.Article 8The provisions of this convention shall not affect the rights and obligations of the carrier under any statute for the time being
force relating to the limitation of the liability of owners of seagoing vessels.Article 9The monetary units mentioned
this convention are to be taken to be gold value.Those contracting States
which the pound sterling is not a monetary unit reserve to themselves the right of translating the sums
dicated

round figures.The national laws may reserve to the debtor the right of discharging his debt
national currency according to the rate of exchange prevailing on the day of the arrival of the ship at the port of discharge of the goods concerned.Article 10The provisions of this convention shall apply to all bills of lading issued

terval of not more than two years from the day on which the convention is signed, the Belgian Government shall place itself
communication with that governments of the High contracting Parties which have declared themselves prepared to ratify the convention with a view to deciding whether it shall be put

a proces-verbal signed by the representatives of the powers which take part therein and by the Belgian Minister for Foreign Affairs.The subsequent deposits of ratifications shall be made by means of a written notification, addressed to the Belgian Government and accompanied by the-
strument of ratification.A duly certified copy of the proces-verbal relating to the first deposit of ratifications, of the notifications referred to
the previous paragraph, and also of the
struments of ratification accompanying them, shall be immediately sent by the Belgian Government through the diplomatic channel to the powers who have signed this convention or who have acceded to it.

form them at the same time of the date on which it received the notification.Article 12Non-signatory States may accede to the present convention whether or not they have been represented at the
ternational Conference at Brussels.A State which desires to accede shall notify its

the archives of the said Government.The Belgian Government shall immediately forward to all the States which have signed or acceded to the convention a duly certified copy of the notification and of the act of accession, mentioning the date on which it received the notification.Article 13The High contracting Parties may at the time of signature, ratification or accession declare that their acceptance of the present convention does not
clude any or all of the self-governing dominions, or of the colonies, oversea possessions, protectorates, or territories under their sovereignty or authority, and they may subsequently accede separately on behalf of any self-governing dominion, colony, oversea possession, protectorate, or territory excluded
their declaration. They may also denounce the convention separately
accordance with its provisions
respect of any self-governing dominion, or any colony, oversea possession, protectorate, or territory under their sovereignty or authority.Article 14The present convention shall take effect,
the case of the States which have taken part
the first deposit of ratifications, one year after the date of the proces verbal recording such deposit. As respects the States which ratify subsequently or which accede, and also

which the convention is subsequently put
to effect
accordance with Article 13, it shall take effect six months after the notifications specified
paragraph 2 of article 11, and paragraph 2 of Article 12, have been received by the Belgian Government.Article 15In the event of one of the contracting States wishing to denounce the present convention, the denunciation shall be notified
writing to the Belgian Government, which shall immediately communicate a duly certified copy of the notification to all the other Sates
forming them of the date on which it was received.The denunciation shall only operate
respect of the State which made the notification, and on the expiry of one year after notification has reached the Belgian Government.Article 16Any one of the contracting States shall have the right to call for a fresh conference with a view to considering possible amendments.A Sate which would exercise this right should notify its
tention to the other Sates through the Belgian Government, which would make arrangements for convening the conference.Done at Brussels,

TERNATIONAL CONVENTION FOR THE UNIFICATION OF CERTAIN RULES OF LAW RELATING TO BILLS OF LADING, 1924, AS AMENDED BY THE PROTOCOL OF 1968 The Contacting Parties to the present Protocol,Being Parties to the
ternational Convention for the unification of certain rules of law relating to bills of lading, done at Brussels on 25th August 1924, as amended by the Protocol to amend that Convention done at Brussels on 23rd February 1968,have agreed as follows: Article IFor the purpose of this Protocol, "Convention" means the
ternational Convention for the unification of certain rules of law relating to bills of lading and its Protocol of signature, done at Brussels on 25th August 1924, as amended by the Protocol, done at Brussels on 23rd February 1968. Article II
- a)of the Convention is replaced by the following:"(
- a)Unless the nature and value of such goods have been declared by the shipper before shipment and

terms of the Special Drawing Right, of a State which is a member of the
ternational Monetary Fund, shall be calculated
accordance with the method of valuation applied by the
ternational Monetary Fund
effect at the date
question for its operations and transactions. The value of the national currency,
terms of the Special Drawing Right, of a State which is not a member of the
ternational Monetary Fund, shall be calculated
a manner determined by that State.Nevertheless, a State which is not a member of the

ternational Convention for the unification of certain rules of law relating to bills of lading, signed at Brussels on 25th August 1924,Have agreed as follows:Article 11.

, paragraph 4, shall be added:"However, proof to the contrary shall not be admissible when the bill of lading has been transferred to a third party acting
good faith."2.

an amount exceeding the equivalent of 10.000 francs per package or unit or 30 francs per kilo of gross weight of the goods lost or damaged, whichever is the higher.(b) The total amount recoverable shall be calculated by reference to the value of such goods at the place and time at which the goods are discharged from the ship

The value of the goods shall be fixed according to the commodity exchange price, or, if there be no such price, according to the current market price, or, if there be no commodity exchange price or current market price, by reference to the normal value of goods of the same kind and quality.(c) Where a container, pallet or similar article of transport is used to consolidate goods the number of packages or units enumerated

Except as aforesaid such article of transport shall be considered the package or unit.(d) A franc means a unit consisting of 65.6 milligrammes of gold of millesimal fineness 900'. The date of conversion of the sum awarded
to national currencies shall be governed by the law of the Court seized of the case.(e) Neither the carrier nor the ship shall be entitled to the benefit of the limitation of liability provided for
this paragraph if it is proved that the damage resulted from an act or omission of the carrier done with
tent to cause damage, or recklessly and with knowledge that damage would probably result.(f) The declaration mentioned
sub-paragraph (a) of this paragraph, if embodied
the bill of lading, shall be prima facie evidence, but shall not be binding or conclusive on the carrier.(g) By agreement between the carrier, master or agent of the carrier and the shipper other maximum amounts than chose mentioned
sub-paragraph (a) of this paragraph may be fixed, provided that no maximum amounts so fixed shall be less than the appropriate maximum mentioned
that sub-paragraph.(h) Neither the carrier nor the ship shall bc responsible
any event for loss or damage to, or
connection with, goods if the nature or value thereof has been knowingly mis-stated by the shipper

serted the following Article 4 bis:"1. The defences and limits of liability provided for
this Convention shall apply
any action against the carrier
respect of loss or damage to goods covered by a contract of carriage whether the action be founded
contract or
tort.2. If such an action is brought against a servant or agent of the carrier (such servant or agent not being an
dependent contractor), such servant or agent shall be entitled to avail himself of the defences and limits of liability which the carrier is entitled to
voke under this Convention.3. The aggregate of the amounts recoverable from the carrier, and such servants and agents, shall
no case exceed the limit provided for
this Convention.4. Nevertheless, a servant or agent of the carrier shall not be entitled to avail himself of the provisions of this Article, if it is proved that the damage resulted from an act or omission of the servant or agent done with
tent to cause damage or recklessly and with knowledge that damage would probably result."Article 4Article 9 of the Convention shall be deleted and replaced by the following:"This Convention shall not affect the provisions of any
ternational Convention or national law governing liability for nuclear damage"Article 5Article 10 of the Convention shall be deleted and replaced by the following: "The provisions of this Convention shall apply to every bill of lading relating to the carriage of goods between ports
two different States if:(a) the bill of lading is issued
a Contracting State, or(b) the carriage is from a port
a Contracting State, or(c) the Contract contained
or evidenced by the bill of lading provides that the rules of this Convention or legislation of any Sate giving effect to them are to govern the contract. Whatever may be the nationality of the ship, the carrier, the shipper, the consignee, or any other
terested person.Each Contracting State shall apply the provisions of this Convention to the bills of lading mentioned above.This Article shall not prevent a Contracting State from applying the Rules of this Convention to bills of lading not
cluded
the preceding paragraphs."Article 6As between the Parties to this Protocol the Convention and the Protocol shall be read and
terpreted together as one single
strument.A party to this Protocol shall have no duty to apply the provisions of this protocol to bills of lading issued
a State which is a Party to the Convention but which is not a Party to this Protocol.Article 7As between the Parties to this Protocol, denunciation by any of them of the Convention
accordance with Article 15 thereof, shall not be construed
any way as a denunciation of the Convention as amended by this Protocol.Article 8Any dispute between two or more Contracting Parties concerning the
terpretation or application of the Convention which cannot be settled through negotiation, shall, at the request of one of them, be submitted to arbitration. If within six months from the date of the request for arbitration the Parties are unable to agree on the organization of the arbitration, any one of those Parties may refer the dispute to the
ternational Court of Justice by request
conformity with the Statute of the Court.Article
- Each Contracting Party may at the time of signature or ratification of this Protocol or accession thereto, declare that it does not consider itself bound by Article 8 of this Protocol. The other Contracting Parties shall not be bound by this Article with respect to any Contracting Party having made such a reservation.
- Any Contracting Party having made a reservation
accordance with paragraph 1 may at any time withdraw this reservation by ratification to the Belgian Government.Article 10This Protocol shall be open for signature by the States which have ratified the Convention or which have adhered thereto before the 23rd February 1968, and by any State represented at the twelfth session (1967-1968) of the Diplomatic Conference on Maritime Law.Article 111. This Protocol shall be ratified.2. Ratification of this Protocol by any State which is not a Party to the Convention shall have the effect of accession to the Convention.3. The
struments of ratification shall be deposited with the Belgian Government.Article
- States, Members of the United Nations or Members of the specialized agencies of the United Nations, not represented at the twelfth session of the Diplomatic Conference on Maritime Law, may accede to this Protocol.
- Accession to this Protocol shall have the effect of accession to the Convention.
- The
struments of accession shall be deposited with the Belgian Government.Article 131. This Protocol shall come
to force three months after the date of the deposit of ten
struments of ratification or accession, of which at least five shall have been deposited by States that have each a tonnage equal or superior to one million gross tons of tonnage.2. For each State which ratifies this Protocol or accedes thereto after the date of deposit of the
strument of ratification or accession determining the coming
to force such as is stipulated
§ 1
of this Article, this Protocol shall come
to force three months after the deposit of its
strument of ratification or accession.Article
- Any Contracting State may denounce this Protocol by notification to the Belgian Government.
- This denunciation shall have the effect of denunciation of the Convention.
- The denunciation shall take effect one year after the date on which the notification has been received by the Belgian Government.Article
- Any Contracting State may at the time of signature, ratification or accession or at any time thereafter declare by written notification to the Belgian Government which among the territories under its sovereignty or for whose
ternational relations it is responsible, are those to which the present Protocol applies.The Protocol shall three months after the date of the receipt of such notification by the Belgian Government extend to the territories named therein, but not before the date of the coming
to force of the Protocol
respect of such State.
- This extension also shall apply to the Convention if the latter is not yet applicable to those territories.
- Any Contracting State which has made a declaration under §1 of this Article may at any time thereafter declare by notification given to the Belgian Government that the Protocol shall cease to extend to such territory. This denunciation shall take effect one year after the date on which notification thereof has been received by the Belgian Government it also shall apply to the Convention.Article 16The Contracting Parties may give effect to this Protocol either by giving it the force of law or by

their national legislation

- a)"Pārvadātājs" ietver sevī kuģa īpašnieku vai fraktētāju, kurš slēdz pārvadājuma līgumu ar nosūtītāju.
- b)"Pārvadāšanas līgums" attiecas tikai uz pārvadāšanas līgumu, kuru apliecina konosaments vai jebkurš cits tam līdzīgs rīkotājdokuments, ciktāl tāds dokuments attiecas uz kravu jūras pārvadājumu; tas arī attiecas uz jebkuru konosamentu vai jebkuru līdzīgu dokumentu, kas izdots uz čartera pamata no tā brīža, kad šāds konosaments vai rīkojuma dokuments regulē attiecības starp pārvadātāju un šī konosamenta vai dokumenta turētāju.
- c)"Krava" sevī ietver mantas, preces, kravas un jebkura veida priekšmetus, izņemot dzīvus dzīvniekus un kravas, kas pārvadāšanas līgumā noteikti kā pārvadājami uz klāja un tiek pārvadāti tādā veidā.
- d)"Kuģis" nozīmē jebkuru kuģi, kas tiek izmantots kravu pārvadāšanai pa jūru.
- e)"Kravu pārvadāšana" aptver periodu no brīža, kad krava ir iekrauta līdz brīdim, kad krava ir izkrauta no kuģa.2. pantsŅemot vērā 6. panta nosacījumus, katrā kravu pārvadāšanas līgumā pa jūru, pārvadātājam attiecībā uz kravas iekraušanu, apstrādi, novietošanu, pārvadāšanu, glabāšanu, tās aprūpi un tās izkraušanu ir jāievēro pienākumi un saistības, un ir tiesības un atvieglojumi, kas norādīti tālāk.3. pants1. Pārvadātājam pirms reisa un to uzsākot jāizrāda saprātīgas rūpes par to, lai:
- a)padarītu kuģi jūrasspējīgu;
- b)pienācīgā veidā nokomplektētu ar ekipāžu un nodrošinātu kuģi ar krājumiem;
- c)padarītu kravas telpas, refrižeratortelpas un saldējamās telpas un visas pārējās kuģa daļas, kurās tiek pārvadāta krava, derīgas un drošas kravas saņemšanai, pārvadāšanai un saglabāšanai.2. Ņemot vērā 4. panta nosacījumus, pārvadātājam pienācīgi un rūpīgi jāiekrauj, jāapstrādā, jānovieto, jāpārvadā, jāglabā pārvadājamā krava, jārūpējas par to un jāizkrauj tā.3. Pieņemot kravu savā pārziņā, pārvadātājam vai kapteinim, vai pārvadātāja aģentam, pēc nosūtītāja pieprasījuma jāizsniedz nosūtītājam konosaments, kurš satur arī šādas ziņas:
- a)atšķirības zīmes, kas ir nepieciešamas kravas identificēšanai, kā tās rakstiski paziņojis nosūtītājs pirms šādas kravas iekraušana ir sākusies, ar noteikumu, ka šīs atšķirības zīmes ir atzīmētas ar zīmogu vai skaidri norādītas citādā veidā uz kravas, ja krava nav iepakota, vai uz kastēm vai iepakojuma, kuros krava atrodas, tādā veidā, lai tās normāli paliktu salasāmas līdz reisa beigām;
- b)vietu vai priekšmetu skaitu, vai daudzumu vai svaru, atkarībā no apstākļiem un saskaņā ar to, kā tos rakstiski norādījis nosūtītājs;
- c)kravas ārēji redzamais izskats un stāvoklis.Tomēr ne pārvadātājam, ne kapteinim, ne pārvadātāja aģentam nav pienākums ziņot vai norādīt konosamentā atšķirības zīmes, vietu skaitu, daudzumu vai svaru, kuri, ja viņiem ir saprātīgs pamats domāt, precīzi neatbilst kravai, ko viņi patiesībā pieņēmuši, vai kuras viņi nespēj saprātīgiem līdzekļiem pārbaudīt.4. Tāds konosaments ir prima facie pierādījums, ka no pārvadātāja puses pieņemta krava, kā tā aprakstīta tajā saskaņā ar 3. panta "a", "b" un "c" punktiem.5. Tiek uzskatīts, ka nosūtītājs ir garantējis pārvadātājam uz nosūtīšanas momentu atšķirības zīmju, kravas vietu skaitu, daudzumu un svaru precizitāti, kā viņš to norādījis, un nosūtītājam jāatlīdzina visi zaudējumi, bojājumi un izdevumi, kas radušies šo datu neprecizitātes rezultātā. Pārvadātāja tiesības uz šāda veida atlīdzību nekādā veidā neierobežo viņa atbildību saskaņā ar pārvadāšanas līgumu pret jebkuru personu, kas nav nosūtītājs.6. Ja tikai paziņojums par zaudējumiem vai bojājumiem un to veids nav iesniegts rakstiski pārvadātājam vai viņa aģentam izkraušanas ostā līdz kravas nodošanai vai nodošanas laikā tās personas rīcībā, kurai pēc pārvadājuma līguma krava ir jānodod šāda nodošana ir prima facie pierādījums, ka pārvadātājs nodevis kravu tādu, kā aprakstīts konosamentā.Ja zaudējumi vai bojājumi nav ārēji redzami, par to jāpaziņo trīs dienu laikā pēc kravas nodošanas.Rakstisks paziņojums nav vajadzīgs, ja kravas stāvoklis tā saņemšanas brīdī bija noteikts kopīgas apskates vai
spekcijas laikā.Jebkurā gadījumā pārvadātājs un kuģis tiek atbrīvots no jebkādas atbildības par zaudējumiem, ja prasība tiesā nav iesniegta gada laikā pēc kravas nodošanas vai datuma, kad to vajadzēja nodot.Reālu vai iespējamu zaudējumu vai bojājumu gadījumā pārvadātājam un saņēmējam ir pienākums savstarpēji sniegt visas saprātīgās iespējas, lai pārbaudītu kravu un saskaitītu vietu skaitu.7. Pēc tam, kad krava ir iekrauta, konosamentam, kurš pārvadātājam, kapteinim vai pārvadātāja aģentam jāizsniedz nosūtītājam, jābūt, ja to pieprasa nosūtītājs, "borta" konosamentam, ar nosacījumu, ka nosūtītājs, ja viņš līdz tam ir saņēmis kādu kravas rīkojuma dokumentu uz šo pašu kravu, atdod šo dokumentu apmaiņā pret "borta" konosamentu. Tomēr, pēc pārvadātāja ieskatiem, šādā kravas rīkojuma dokumentā iekraušanas ostā var tik izdarītas pārvadātāja, kapteiņa vai pārvadātāja aģenta atzīmes par kuģa vai kuģu nosaukumiem, kuros kravas iekrautas, par nosūtīšanas datumu vai datumiem, un, šādā veidā iezīmēts, šis dokuments, ja tas satur ziņas, kas uzrādītas 3. panta 3. daļā, šī panta nozīmē jāuzskata par "borta" konosamentu.8. Jebkura atruna, nosacījums vai vienošanās pārvadāšanas līgumā, kas atbrīvo pārvadātāju vai kuģi no atbildības par zaudējumiem, kas skar kravu, kuri radušies nevērības, vainas vai pienākumu un saistību neizpildes dēļ, kuri ir paredzēti šajā pantā, vai samazinot šādu atbildību citādā veidā, kā tas paredzēts šajā Konvencijā, tiek uzskatīti par nenozīmīgiem, nederīgiem un spēkā neesošiem. Nosacījumi par apdrošināšanas atlīdzības nodošanu pārvadātājam vai jebkurš līdzīgs nosacījums jāuzskata kā pārvadātāja atbrīvošana no atbildības.4. pants1. Ne pārvadātājs, ne kuģis neatbild par zaudējumiem vai bojājumiem, kuri radušies jūrasnespējas dēļ, ja vien šī jūrasnespēja nav izsaukta saprātīgu rūpju trūkuma dēļ no pārvadātāja puses, lai padarītu kuģi jūrasspējīgu vai to pienācīgā veidā nokomplektētu ar ekipāžu, iekārtām un krājumiem un padarītu kravas telpas, refrižeratortelpas un saldējamās telpas un visas citas kuģa daļas, kurās tiek pārvadāta krava, atbilstošas un drošas kravas uzņemšanai, pārvadāšanai un glabāšanai, saskaņā ar 3. panta 1. daļas noteikumiem. Vienmēr, kad zaudējumi vai bojājumi ir radušies jūrasnespējas dēļ, pārvadātājam vai citām personām, kuras prasa atbrīvošanu no atbildības, kas paredzēta šajā pantā, ir jāpierāda, ka viņas ir bijušas pietiekami rūpīgas.2. Ne pārvadātājs, ne kuģis neatbild par zaudējumiem vai bojājumiem, kas radušies:
- a)kapteiņa, ekipāžas locekļa, loča vai pārvadātāja kalpotāju darbības, nolaidības vai saistību nepildīšanas dēļ kuģošanā vai kuģa vadīšanā;
- b)ugunsgrēka, ja vien tas nav izcēlies pārvadātāja vainas vai darbības dēļ;
- c)jūras risku vai citu kuģojamu ūdeņu briesmu vai nejaušības dēļ;
- d)nepārvaramas varas dēļ;
- e)karadarbības dēļ;
- f)antisabiedrisku elementu darbības rezultātā;
- g)varas, valdītāju vai tautas aresta vai aizturēšanas dēļ, vai tiesas aresta uzlikšanas dēļ;
- h)karantīnas ierobežojumu dēļ;
- i)nosūtītāja vai kravas īpašnieka, viņa aģenta vai pārstāvja darbības vai nolaidības dēļ;
- j)streiku, lokautu vai kādu citu iemeslu dēļ, kad pilnīgi vai daļēji tiek apstādināts vai aizturēts darbs;
- k)sacelšanās vai tautas nemieru dēļ;
- l)dzīvības vai īpašuma glābšanas vai glābšanas mēģinājuma dēļ uz jūras;
- m)apjoma vai svara zaudējumu vai jebkuru citu zaudējumu vai bojājumu dēļ, kuri radušies slēptu nepilnību, īpaša kravas rakstura vai kravām raksturīgu defektu dēļ;
- n)nepietiekama iepakojuma dēļ;
- o)nepilnīga vai nepietiekama marķējuma dēļ;
- p)slēptu nepilnību, kuras nevar atklāt izrādot saprātīgas rūpes;
- q)jebkuru citu iemeslu dēļ, kuri radušies bez pārvadātāja kļūdas vai personiskās vainas un ne aģentu vai pārvadātāja kalpotāju darbību rezultātā un ne viņu vainas dēļ; tomēr personai, kura prasa atbrīvošanu no atbildības ir jāpierāda, ka ne pārvadātāja darbība vai personiskā vaina, ne aģentu vai pārvadātāja kalpotāju darbība vai vaina neveicināja zaudējumus vai bojājumus.3. Nosūtītājs neatbild par pārvadātāja vai kuģa ciestajiem zaudējumiem vai bojājumiem, kas radušies jebkura iemesla dēļ, bez nosūtītāja, viņa aģenta, viņa kalpotāju darbības, vainas vai nevērības.4. Nekāda deviācija, lai glābtu vai mēģinātu glābt dzīvību vai īpašumu jūrā vai jebkura saprātīga deviācija netiek uzskatīta par šīs Konvencijas vai pārvadājuma līguma pārkāpumu, un pārvadātājs nav atbildīgs par jebkuriem zaudējumiem vai bojājumiem, kas radušies tā rezultātā.5. Pārvadātājs un kuģis nekādā gadījumā neatbild par zaudējumiem, kas nodarīti kravai vai sakarā ar to, par summu, kas pārsniedz 100 sterliņu mārciņas par vietu vai kravas vienību jeb šādas summas ekvivalentu citā valūtā, ja vien šo kravu raksturu un vērtību nav paziņojis nosūtītājs līdz iekraušanai un tie nav ietverti konosamentā.Šis paziņojums, ja tas ir ietverts konosamentā, ir prima facie pierādījums, bet tas nav saistošs pārvadātājam, kurš var to apstrīdēt.Pēc vienošanās starp pārvadātāju, kapteini vai pārvadātāja aģentu un nosūtītāju var tik noteikta cita maksimālā summa, nekā tas ir norādīts šajā punktā, ar nosacījumu, ka šāds saskaņots maksimums nav mazāks kā iepriekšnorādītā summa.Ne pārvadātājs, ne kuģis nekādā gadījumā neatbild par zaudējumiem vai bojājumiem, kuri nodarīti kravai vai sakarā ar to, ja nosūtītājs konosamentā apzināti sniedzis nepatiesas ziņas par kravas raksturu vai vērtību.6. Viegli uzliesmojošu, sprāgstošu vai bīstamu kravu, kuru iekraušanai pārvadātājs, kapteinis vai pārvadātāja aģents nav piekritis, zinot tās dabu un raksturu, pārvadātājs bez kompensācijas tās var jebkurā laikā līdz izkraušanai izkraut no kuģa jebkurā vietā vai iznīcināt, vai padarīt nekaitīgas, un šādas kravas nosūtītājs nes atbildību par visiem zaudējumiem un izdevumiem, kuri tieši vai netieši radušies tās iekraušanas rezultātā. Ja kāda no tādām kravām, kas iekrauta ar pārvadātāja ziņu un piekrišanu, kļūs bīstama kuģim vai kravai, pārvadātājs to var tādā pašā veidā izkraut no kuģa, iznīcināt vai padarīt nekaitīgu, pārvadātājam par to neatbildot, izņemot vispārējas avārijas gadījumu, ja tā notiks.5. pantsPārvadātājam ir tiesības atteikties no visām vai dažām savām tiesībām, saskaņā ar šo Konvenciju, tajā skaitā no tiesībām par atbrīvošanu no atbildības, vai palielināt savu atbildību un saistības, kas paredzētas šajā Konvencijā, ar nosacījumu, ka šāda atteikšanās vai palielināšana būs ietverta konosamentā, kas izdots nosūtītājam.Nekādi šīs Konvencijas noteikumi netiek piemēroti čarteriem; bet, ja konosamenti izdoti gadījumam, kad kuģis ir čarterā, tiem jābūt saskaņā ar šīs Konvencijas noteikumiem. Nekas šajos noteikumos nav par šķērsli, lai konosamentā iekļautu jebkādu tiesisku nosacījumu, kas skar vispārējo avāriju.6. pantsNeskatoties uz iepriekšējo pantu noteikumiem, pārvadātājs, kapteinis vai pārvadātāja aģents un nosūtītājs, ir tiesīgi slēgt jebkādu vienošanos attiecībā uz jebkurām kravām par jebkuriem nosacījumiem attiecībā uz pārvadātāja pienākumiem un atbildību par tādām kravām, kā pārvadātāja tiesībām attiecībā uz šādām kravām, ieskaitot tiesības uz atbrīvošanu no atbildības, vai attiecībā uz viņa pienākumiem kuģa jūrasspējas nodrošināšanā, tā kā noteikumi par to nav pretrunā ar sabiedrisko kārtību, vai attiecībā uz viņa kalpotāju vai aģentu rūpēm par jūras kravu iekraušanu, apstrādi, novietošanu, pārvadāšanu, glabāšanu, izkraušanu, ar nosacījumu, ka šajā gadījumā nav bijis vai netiks izsniegts nekāds konosaments un, ka saskaņotie noteikumi ir ietverti kvītī, kura nav preču rīkojuma dokuments un ietver atzīmi par to.Jebkurai šādā veidā noslēgtai vienošanai ir pilnā mērā likumīgs spēks.Taču tiek ņemts vērā, ka šis pants netiek pielietots parastai komerciālai kravas nosūtīšanai, kas tiek veikta parastas tirdzniecības procesā, bet tikai pie citādiem sūtījumiem, kad pārvadājamā īpašuma raksturs un stāvoklis, vai apstākļi, termiņi un nosacījumi, pie kādiem jānotiek pārvadāšanai, ir tādi, kas attaisno sevišķu vienošanos.7. pantsNekādi šīs Konvencijas noteikumi neliedz pārvadātājam vai nosūtītājam ietvert līgumā noteikumus, nosacījumus, atrunas un izņēmumus attiecībā uz pārvadātāja vai kuģa pienākumiem un atbildību par zaudējumiem vai bojājumiem, kuri radušies kravai vai, kas skar tās glabāšanu, rūpes par to un tās apstrādi līdz iekraušanai un, attiecīgi, pēc izkraušanas no kuģa, uz kura kravas pārvadā pa jūru.8. pantsŠis Konvencijas noteikumi neskar ne pārvadātāja tiesības, ne pienākumus, kuri izriet no jebkura spēkā esoša likuma attiecībā uz jūras kuģu īpašnieku atbildības ierobežošanu.9. pantsNaudas vienībām, kas minētas Konvencijā, ir zelta segums.Līgumslēdzējvalstis, kurās sterliņu mārciņa nav valūtas vienība, patur tiesības pārvērst summas, kas norādītas šajā Konvencijā sterliņu mārciņās, savas valūtas sistēmas vienībās, noapaļojot līdz veseliem skaitļiem.Nacionālie likumi var saglabāt tiesības parādniekam nomaksāt parādu nacionālā valūtā, vadoties pēc valūtas kursa dienā, kad izkraušanas ostā ienāk kuģis ar attiecīgu kravu.10. pantsŠīs Konvencijas noteikumus piemēro jebkuram konosamentam, kurš ir izdots kādā no līgumslēdzējvalstīm.11. pantsPēc ne vairāk kā diviem gadiem, skaitot no Konvencijas parakstīšanas dienas, Beļģijas valdībai, stājoties attiecībās ar Augsto Līgumslēdzējpušu valdībām, kuras izrādījušas gatavību ratificēt Konvenciju, jāizlemj, vai tai ir jāpiešķir spēks. Ratificēšanas raksti tiks nodoti glabāšanai Briselē dienā, kas tiks noteikta ar vispārēju minēto valstu valdību vienošanos. Pirmo ratificēšanas rakstu deponēšanu fiksē proces verbal, kuru paraksta tajā piedalošos valstu pārstāvji un Beļģijas ārlietu ministrs.Turpmāko ratificēšanas rakstu nodošanu glabāšanā veic ar rakstiska ziņojuma palīdzību, kurš adresēts Beļģijas valdībai un kuram tiks pievienots ratificēšanas dokuments.Šādā veidā apliecinātas protokola kopijas par pirmo ratificēšanas rakstu, ziņojumu deponēšanu, kuri minēti iepriekšējā rindkopā, kā arī tiem pievienoto ratifikācijas dokumentu, Beļģijas valdība nekavējoties pa diplomātiskiem kanāliem nosūta valstīm, kuras parakstījušas šo Konvenciju vai tai pievienojušās. Gadījumos, kas paredzēti iepriekšējā rindkopā, minētā valdība vienlaicīgi paziņo tām ziņojuma saņemšanas datumu.12. pantsValstis, kas nav parakstījušas šo Konvenciju, var tai pievienoties neatkarīgi no tā, vai viņas ir bijušas pārstāvētas Starptautiskajā konferencē Briselē.Valsts, kas vēlas pievienoties Konvencijai, rakstiski paziņo par savu nodomu Beļģijas valdībai, nosūtot tai dokumentu par pievienošanos, kurš glabājas iepriekšminētās valdības arhīvos.Beļģijas valdība nekavējoties nosūta visām valstīm, kuras parakstījušas Konvenciju vai tai pievienojušās, pienācīgā veidā apstiprinātu paziņojuma kopiju, kā arī dokumentu par pievienošanos, norādot datumu, kad tā saņēmusi paziņojumu.13. pantsAugstās Līgumslēdzējpuses parakstīšanas, ratificēšanas vai pievienošanās laikā var paziņot, ka šīs Konvencijas pieņemšana neattiecas uz visām vai dažām autonomajā domīnijām vai kolonijām, aizjūras valdījumiem, protektorātiem vai teritorijām, kurām ir sava suverenitāte vai vara un tās var vēlāk pievienoties atsevišķi, ikvienas autonomās domīnijas, kolonijas, aizjūras valdījuma, protektorāta vai teritorijas, kas bija izslēgtas ar sākotnējo ziņojumu, vārdā. Tās var arī denonsēt šo Konvenciju atsevišķi saskaņā ar to noteikumiem, par ikvienas autonomās domīnijas, kolonijas, aizjūras valdījuma, protektorāta vai teritorijas, suverenitāti vai varu.14. pantsAttiecībā uz valstīm, kuras pirmās ir deponējušas ratificēšanas dokumentus, šī Konvencija stājas spēkā pēc gada no proces verbal, par šo deponēšanu, parakstīšanas dienas. Kas attiecas uz valstīm, kas Konvenciju ratificē vēlāk vai tai pievienojas, un gadījumos, kad Konvencijai tiek piešķirts spēks kā tas norādīts 13. pantā, tad Konvencija stājas spēkā pēc sešiem mēnešiem pēc Beļģijas valdības paziņojuma, kas paredzēts 11. panta 2. daļā un 12. panta 2. daļā.15. pantsGadījumā, ja viena no Līgumslēdzējvalstīm vēlas denonsēt šo Konvenciju, nepieciešams rakstiski paziņot par denonsēšanu Beļģijas valdībai, kura nekavējoties nosūta visām citām valstīm atbilstošā veidā apstiprinātu šī paziņojuma kopiju, pie tam norādot tā saņemšanas datumu.Denonsēšana stājas spēkā tikai attiecībā uz valsti, kurai par to ir paziņots, un pēc viena gada paiešanas no brīža, kad Beļģijas valdība saņēma paziņojumu.16. pantsKatrai no Līgumslēdzējvalstīm ir tiesības pieprasīt sasaukt jaunu konferenci ar nolūku izskatīt grozījumus, kurus varētu iekļaut šajā Konvencijā.Valsts, kura izmantos šo iespēju, ar Beļģijas valdības starpniecību paziņo par savu nodomu citām valstīm, kuras uzņemsies sasaukt konferenci.Parakstīta Briselē, vienā eksemplārā, 1924. gada 25. augustā.PARAKSTĪŠANAS PROTOKOLSParakstot Starptautisko konvenciju, par dažu noteikumu konosamenta unifikāciju, zemāk parakstījušies pilnvarotie pārstāvji pieņēma šo protokolu, kuram ir tāds pats spēks un nozīme, kā, kad tā noteikumi būtu iekļauti Konvencijas tekstā, uz kuru tas attiecas.Augstās Līgumslēdzējpuses var piešķirt spēku šai Konvencijai, dodot tai likuma spēku, vai iekļaujot savā nacionālajā likumdošanā noteikumus, kurus Konvencija pieņēmusi, atbilstoši savai likumdošanai.Tās noteikti saglabā tiesības:1) noteikt, ka gadījumos, kas paredzēti 4. panta 2. daļas "c-p" punktos, konosamenta turētājs var pierādīt pārvadātāja vai viņa kalpotāju vainas esamību, kas nav ietverts "a" punktā;2) pielietot attiecībā uz nacionālajiem kabotāžas braucieniem 6. pantu visām kravām bez uzskaites ierobežojumiem, kas uzskaitīti minētā panta pēdējā rindkopā.Parakstīts Briselē 1924. gada 25. augustā, vienā eksemplārā. 1968.gada protokols par grozījumiem 1924.gada Starptautiskajā konvencijā par dažu konosamenta noteikumu unifikāciju (Visbijas protokols) Līgumslēdzējpuses, uzskatīdamas par vēlamu papildināt Starptautisko konvenciju par dažu konosamenta noteikumu unifikāciju, kas parakstīta Briselē 1924.gada 25.augustā, vienojās par sekojošo:1. pants1. 3.panta 4.daļa tiek papildināta ar sekojošu tekstu: "Tomēr nav pieļaujams pierādījums par pretējo, kad konosaments nodots godprātīgai trešajai pusei".2. 3.panta 6.daļas ceturtais punkts tiek svītrots un nomainīts ar sekojošiem noteikumiem: "Ievērojot 6-bis punkta noteikumus, pārvadātājs un kuģis jebkurā gadījumā tiek atbrīvoti no jebkādas atbildības attiecībā uz kravu, ja tikai prasība nav iesniegta gada laikā pēc tās nodošanas vai datuma, kad tai vajadzēja būt nodotai. Šis termiņš tomēr var tikt pagarināts, ja puses tā vienojas pēc tam, kad ir radies pamats prasībai".3. Pēc 3.panta 6.daļas tiek pievienots sekojošs 6-bis punkts:"Regresa prasību var celt pat pēc gada termiņa, kas paredzēts iepriekšējā punktā, izbeigšanās, ja tā tiek celta laikā, ko atļāvis tiesas, kas izskata lietu, likums. Tomēr pieļaujamajam laikam jābūt ne mazākam kā trīs mēneši, skaitot no dienas, kad persona, kas ceļot šādu regresa prasību, apmierinājusi prasību vai saņēmusi paziņojumu par lietas ierosināšanu pret viņu pašu".2. pants4.panta 5.daļa tiek svītrota un nomainīta ar sekojošu tekstu:"
- a)Ja kravas raksturu un vērtību nosūtītājs nav paziņojis līdz nosūtīšanai un tas nav ierakstīts konosamentā, ne pārvadātājs, ne kuģis nekādā gadījumā neatbild par jebkuru zaudējumu vai bojājumu, kas nodarīti kravai vai saistībā ar to, par summu, kas pārsniedz 10 000 franku ekvivalentu par vietu vai vienību vai 30 franku ekvivalentu par vienu zaudētās vai bojātās kravas bruto svara kilogramu, atkarībā no tā, kura summa ir lielāka.
- b)Kopīgā summa, kas jāatlīdzina, tiek aprēķināta, izejot no kravas vērtības tajā vietā un tajā laikā, kur un kad tā izkrauta vai tai vajadzēja būt izkrautai no kuģa atbilstoši līgumam. Kravas vērtību nosaka pēc preču biržas cenas vai, ja nav tādas cenas — pēc eksistējošās tirgus cenas, bet, ja nav ne vienas, ne otras cenas — izejot no parastās šāda veida un kvalitātes kravas vērtības.
- c)Kad kravu apvienošanai izmanto konteinerus, paletes vai līdzīgas transporta ierīces, vietu skaits vai kravas vienības, kas uzrādītas konosamentā kā iepakotas šādā transporta ierīcē, šajā punktā tiek uzskatītas par vietu skaitu un kravas vienībām. Izņemot norādīto gadījumu, šāda transporta ierīce tiek uzskatīta par vietu vai kravas vienību.
- d)Franks nozīmē vienību, kas satur 65,5 miligramus 900-tās proves zelta. Piespriestās summas pārrēķina datums nacionālajā valūtā tiek noteikts pēc tiesas, kas izskata šo lietu, likuma.
- e)Ne pārvadātājam, ne kuģim nav tiesību izmantot atbildības ierobežošanu, kas paredzēta šajā punktā, ja ir pierādīts, ka zaudējums radies pārvadātāja darbības vai nolaidības dēļ, veikts ar nolūku radīt zaudējumus vai neapdomības dēļ un apzinoties ka zaudējumi varētu rasties.
- f)Paziņojums, kas pieminēts šīs daļas "a" punktā, ja tas ir ietverts konosamentā, ir prima facie pierādījums, bet nav saistošs pārvadātājam, kurš to var apstrīdēt.
- g)Pēc līguma starp pārvadātāju, kapteini vai pārvadātāja aģentu un nosūtītāju var tikt noteiktas citas maksimālās summas, nekā tās, kas norādītas šīs daļas "a" punktā, ar nosacījumu, ka šādā veidā saskaņotā maksimālā summa nav mazāka par attiecīgo maksimumu, kas norādīta šajā punktā.
- h)Ne pārvadātājs, ne kuģis nekādā gadījumā neatbild par zaudējumiem vai bojājumiem, kas nodarīti kravai vai saistībā ar to, ja nosūtītājs apzināti nepatiesi konosamentā paziņojis tās raksturu vai vērtību".3. pantsStarp Konvencijas 4. un 5.pantu tiek ievietots sekojošs 4-bis pants:"1. Noteikumi par atbrīvošanu no atbildības un tās robežas, ko nosaka šī Konvencija, tiek piemēroti jebkurai prasībai pret pārvadātāju kravas zaudējumu vai bojājumu gadījumā, uz kuriem attiecas pārvadāšanas līgums, neatkarīgi no tā, vai prasība izriet no līguma vai delikta (neatļautas darbības).2. Ja šāda prasība piestādīta pārvadātāja kalpotājam vai aģentam (ja šāds kalpotājs vai aģents nav neatkarīgs darba uzņēmējs), tad šim kalpotājam vai aģentam ir tiesības izmantot noteikumus par atbrīvošanu no atbildības un tās robežas, uz kuriem pārvadātājam ir tiesības balstīties saskaņā ar šo Konvenciju.3. Kopējās summas, ko atlīdzina pārvadātājs un tādi kalpotāji un aģenti, nekādā gadījumā nedrīkst kopumā pārsniegt robežu, kas paredzēta šajā Konvencijā.4. Tomēr, pārvadātāja kalpotājam vai aģentam nav tiesību izmantot šī panta noteikumus, ja pierādīts, ka zaudējums ir radies šī kalpotāja vai aģenta darbības vai nolaidības rezultātā, kas veikta ar nolūku radīt zaudējumus vai neapdomības dēļ un apzinoties, ka zaudējumi varētu rasties."4. pantsKonvencijas 9.pants tiek svītrots un nomainīts ar sekojošo:"Šī Konvencija neietekmē nevienas starptautiskās konvencijas noteikumus vai nacionālos likumus, kuri regulē atbildību par kodolzaudējumiem".5. pantsKonvencijas 10.pants tiek svītrots un nomainīts ar sekojošiem noteikumiem:"Šīs Konvencijas noteikumi tiek pielietoti attiecībā uz jebkuru konosamentu, kurš attiecas uz kravu pārvadāšanu starp divu dažādu valstu ostām, ja:
- a)konosaments ir izdots Līgumslēdzējvalstī, vaib) pārvadāšana notiek no ostas, kura atrodas Līgumslēdzējvalstī, vaic) ja līgums, kas ir ietverts konosamentā vai tas ir apstiprināts ar konosamentu, paredz, ka šīs Konvencijas noteikumi vai kādas valsts likumdošana, kas tos pielieto, regulē šo līgumu, lai arī kāda būtu kuģa, pārvadātāja, nosūtītāja, saņēmēja vai jebkuras citas ieinteresētās personas valstiskā piederība.Katra Līgumslēdzējvalsts pielieto šīs Konvencijas noteikumus attiecībā pret augstākminētajiem konosamentiem.Šis pants neliedz Līgumslēdzējvalstij konosamentos, kas nav uzrādīti iepriekšējos punktos, izmantot šīs Konvencijas noteikumus".6. pantsAttiecībās starp šī Konvencijas Protokola Dalībvalstīm, Konvencija un Protokols tiek uzskatīti un skaidroti kopā kā viens vesels dokuments.Protokola Dalībvalstij nav pienākums pielietot šī Protokola noteikumus attiecībā uz konosamentiem, kas izdoti valstī, kas ir Konvencijas Dalībvalsts, bet ne šī Protokola Dalībvalsts.7. pantsAttiecībās starp šī Protokola Dalībvalstīm, vienas no tām Konvencijas denonsēšana atbilstoši 15.pantam nekādā gadījumā nenozīmē Konvencijas, kas grozīta ar šo Protokolu, denonsēšanu.8. pantsJebkurš strīds starp Līgumslēdzējpusēm, kas skar Konvencijas skaidrojumu vai pielietojumu, kurš nevar tikt noregulēts pārrunu ceļā, tiek nodots pēc vienas no tām lūguma, izskatīšanai šķīrējtiesā. Ja sešu mēnešu laikā no lūguma par izskatīšanu šķīrējtiesā, Puses nevar vienoties par arbitrāžas organizēšanu, jebkura no šīm pusēm var iesniegt strīdu Starptautiskajā tiesā, nosūtot lūgumu par to atbilstoši Tiesas Statūtiem.9. pants1. Katra no Līgumslēdzējpusēm šī Protokola parakstīšanas vai ratificēšanas, vai tam pievienošanās laikā var paziņot, ka tā neuzskata šī protokola 8.pantu par sev saistošu. Pārējām Līgumslēdzējpusēm nav saistošs šis pants attiecībā uz Līgumslēdzējpusi, kura ir izdarījusi šo atrunu.2. Jebkura Līgumslēdzējpuse, kura ir izdarījusi atrunu atbilstoši 1.punktam, var jebkurā laikā to atsaukt par to paziņojot Beļģijas Valdībai.10. pantsŠis Protokols ir atvērts parakstīšanai valstīm, kuras ratificējušas Konvenciju vai pievienojušās tai līdz 1968.gada 23.februārim, un jebkurai valstij, kura piedalījusies Jūras tiesību Diplomātiskās konferences divpadsmitajā sesijā (1967-1968).11. pants1. Šis Protokols ir jāratificē.2. Ja šo Protokolu ratificē valsts, kas nav Konvencijas Dalībvalsts, tad tādai ratificēšanai ir pievienošanās Konvencijai efekts.3. Ratificēšanas raksti tiek nodoti glabāšanā Beļģijas valdībai.12. pants1. Valstis, kuras ir Apvienoto Nāciju Organizācijas dalībnieces vai Apvienoto Nāciju Organizācijas Specializētās aģentūras dalībnieces, un kuras nav piedalījušās Jūras tiesību Diplomātiskās konferences divpadsmitajā sesijā, var pievienoties šim Protokolam.2. Pievienošanās šim Protokolam ir pievienošanās Konvencijai efekts.3. Dokumenti par ratificēšanu tiek nodoti glabāšanā Beļģijas valdībai.13. pants1. Šis Protokols stājas spēkā pēc trim mēnešiem, skaitot no dienas, kad desmit dokumenti par ratificēšanu vai pievienošanos tiek nodoti glabāšanā, no kuriem piecas ir tādas valstis, kuru kuģu tonnāža ir vienāda vai pārsniedz vienu miljonu bruto tonnas.2. Katrai valstij, kura ratificē šo Protokolu vai pievienojas tam pēc datuma, kad ratificēšanas vai pievienošanās dokuments nodots glabāšanā, un izraisa Protokola stāšanos spēkā, kā tas paredzēts šī panta 1.punktā, šis Protokols stājas spēkā pēc trīs mēnešiem, skaitot no dienas, kad dokuments par ratifikāciju vai pievienošanos nodots glabāšanā.14. pants1. Katra Līgumslēdzējvalsts var denonsēt šo Protokolu, nosūtot paziņojumu par to Beļģijas valdībai.2. Šādas denonsēšanas rezultāts ir Konvencijas denonsēšana.3. Denonsēšana stājas spēkā pēc viena gada, skaitot no dienas, kad Beļģijas valdība saņēmusi šādu paziņojumu.15. pants1. Katra Līgumslēdzējvalsts, parakstot Konvenciju, to ratificējot vai pievienojoties tai vai jebkurā laikā pēc tam rakstiski paziņojot Beļģijas valdībai, var paziņot uz kādām teritorijām, kuras ir suverēnas vai par kuru starptautiskajām attiecībām tā ir atbildīga, attiecas šis Protokols.Protokols attiecas uz šīm paziņojumā nosauktajām teritorijām pēc trim mēnešiem, skaitot no dienas, kad Beļģijas valdība to saņēmusi, bet ne ātrāk par dienu, kad Protokols stājies spēkā attiecībā pret doto valsti.2. Šāds pielietojums tāpat attiecas uz Konvenciju, ja tā vēl netiek piemērota šādām teritorijām.3. Jebkura Līgumslēdzējvalsts, kura izdarījusi paziņojumu, pamatojoties uz šī panta 1.daļu, var jebkurā laikā pēc tam paziņot, nosūtot paziņojumu Beļģijas valdībai, ka Protokols pārstāj darboties attiecīgā teritorijā. Šī denonsēšana stājas spēkā pēc viena gada, skaitot no dienas, kad Beļģijas valdība saņēmusi paziņojumu un tas attiecas arī uz Konvenciju.16. pantsLīgumslēdzējpuses var piemērot šo Protokolu tam piešķirot likuma spēku, vai iekļaujot šī protokola noteikumus savā nacionālajā likumdošanā, formā, kas atbilst šai likumdošanai.17. pantsBeļģijas valdība paziņo valstīm, kuras piedalījās Jūras tiesību Diplomātiskās konferences divpadsmitajā sesijā (1967-1968), valstīm, kuras pievienojušās Protokolam, un valstīm, kuras ir Konvencijas Dalībvalstis sekojošo:1) parakstīšanu, ratifikāciju un pievienošanos, kuras ir saņemtas saskaņā ar 10., 11. un 12.pantu;2) šī Protokola spēkā stāšanās datumu, atbilstoši 13.pantam;3) paziņojumus par teritoriālo piemērošanu, atbilstoši 15.pantam;4) denonsēšanas paziņojumus, kas saņemti atbilstoši 14.pantam.Apliecinot to, apakšā parakstījušies pilnvarotie pārstāvji, kuri pienācīgā veidā tikuši pilnvaroti, ir parakstījuši šo Protokolu.Parakstīts Briselē, 1968.gada 23.februārī, franču un angļu valodās, abi teksti ir autentiski, vienā eksemplārā, kurš paliek glabāšanā Beļģijas valdības arhīvā, kura izsniegs pienācīgi apstiprinātas kopijas. 1979.gada protokols par grozījumiem 1924.gada Starptautiskajā konvencijā par dažu konosamenta noteikumu unifikāciju, kas grozīta ar 1968.gada protokolu (SDR PROTOKOLS 1979) Šā Protokola Līgumslēdzējpuses,Esot Starptautiskās konvencijas par dažu konosamenta noteikumu unifikāciju, kas parakstīta Briselē 1924.gada 25.augustā un grozīta ar Protokolu, kas parakstīts Briselē 1968.gada 23.februārī, Pusēmir vienojušās:I pantsŠajā Protokolā "konvencija" nozīmē Starptautisko konvenciju par dažu konosamenta noteikumu unifikāciju, kas parakstīta Briselē 1924. gada 25.augustā, kas grozīta ar protokolu, kas parakstīts Briselē 1968.gada 23.februārī.II pants
- a)punkts ir aizvietots ar sekojošo:"(
- a)ja ziņas par šo kravu raksturu un vērtību nav paziņojis nosūtītājs līdz iekraušanai un tās nav ietvertas konosamentā, ne pārvadātājs, ne kuģis nekādā gadījumā neatbild par zaudējumiem vai bojājumiem, kas nodarīt kravai vai sakarā ar to par summu, kas pārsniedz 666.67 norēķina vienības par vietu vai kravas vienību vai 2 norēķina vienības par nozaudētās vai sabojātās kravas bruto svara vienu kilogramu, ņemot vērā lielāko."
- d)punkts ir aizvietots ar sekojošo:"(
- d)šajā pantā minētā norēķina vienība ir Speciālās aizņemšanās tiesības, ko noteicis Starptautiskais Valūtas fonds. Summas, kas minētas šīs daļas (
- a)punktā, konvertē nacionālajā valūtā, pamatojoties uz šīs valūtas vērtību datumā, ko noteikusi tiesa, kas izskata lietu.Nacionālas valūtas vērtību Speciālo Aizņemšanās Tiesību izteiksmē valstij, kura ir Starptautiskā Valūtas fona dalībniece, aprēķina pēc taksācijas metodes, ko apspriežamajā datumā piemēro Starptautiskais Valūtas fonds savās operācijās un transakcijās. Nacionālās valūtas vērtību Speciālo aizņemšanās tiesību izteiksmē valstij, kura nav Starptautiskā Valūtas fonda dalībniece, aprēķina pēc metodes, ko noteikusi šī valsts.Tomēr valsts, kura nav Starptautiskā Valūtas fonda dalībvalsts un kuras likumdošana nepieļauj iepriekšējā teikuma nosacījumu piemērošanu, ratificējot 1979.gada Protokolu vai pievienojoties tam, vai jebkurā laikā pēc tam var paziņot, ka atbildības robežu, ko paredz šī Konvencija, tās teritorijā nosaka šādi:(
- i)attiecībā uz 666.67 norēķinu vienību summu, kas minēta šā panta 5.daļas (
- a)punktā, 10,000 valūtas vienības;(
- ii)attiecībā uz 2 norēķinu vienībām, kas minētas šā panta 5.daļas (
- a)punktā, 30 valūtas vienības.Valūtas vienība, kas minēta iepriekšējā teikumā atbilst sešdesmit pieciem un pus gramam 900-tās proves zeltam. Šajā teikumā noteikto summu konvertēšanu nacionālajā valūtā veic saskaņā ar attiecīgās valsts likumdošanu.Aprēķināšanu un konvertēšanu, kas minēta iepriekšējos teikumos, īsteno tādā veidā, lai valsts nacionālajā valūtā iespējami tuvāk izteiktu tādu pašu reālo vērtību, kāda ir šā panta 5.daļas (
- a)punktā minētajām summām, kas tur ir izteiktas norēķinu vienībās.Deponējot 1979.gada protokola ratificēšanas vai pievienošanās dokumentu, valstis paziņo depozitārijam aprēķināšanas metodi vai konvertēšanas rezultātu, atkarībā no gadījuma."III pantsJebkuru strīdu starp divām vai vairākām Līgumslēdzējpusēm par šā Protokola
terpretēšanu vai piemērošanu, kuru nevar noregulēt sarunu ceļā, pēc vienas no tām lūguma, nodod šķīrējtiesai. Ja sešu mēnešu laikā, skaitot no datuma, kad pieprasīta šķīrējtiesa, Dalībvalstis nespēj vienoties par šķīrējtiesas organizēšanu, ikviena no Pusēm var iesniegt strīdu Starptautiskajā tiesā, nosūtot lūgumu par to atbilstoši Tiesas statūtiem.IV pants
