ASSIGNMENT OF STATUTORY MINISTERIAL
RESPONSIBILITIES ACT
To provide for the assignment of statutory responsibilities to Ministers.
7th August, 2018
ACT XL of 2016, as amended by Legal Notice 265 of 2018, Act XXIX of
2019. and Legal Notice 503 of 2021. and Acts XL of 2023, XVII and XXXIII
of 2024.
1. (1) The short title of this Act is the Assignment of Statutory
Ministerial Responsibilities Act.
2.
In this Act, unless the context otherwise requires:
Short title.
Interpretation.
"area of responsibility" means any business of the Government
of Malta for which responsibility may be assigned to a Minister
under article 82 of the Constitution, and includes the consolidated
areas of responsibility that are listed in the Schedule;
"consolidated area of responsibility" means any of the areas of
responsibility that are established under this Act and listed in the
first column of the Schedule;
"Minister" means any Minister appointed in accordance with
article 80 of the Constitution, and shall for the purposes of this Act,
include the Prime Minister;
"related law" means any law which is listed in the second column
of the Schedule against a consolidated area of responsibility;
"statutory title" means any title by means of which a Minister is
identified, designated or assigned functions in a related law, and
which is listed in the third column of the Schedule.
3. (1) When the President, acting in accordance with article
82 of the Constitution, assigns to a Minister an area of
responsibility identical to a consolidated area of responsibility as
listed in the first column of the Schedule, that Minister shall:
(a) be regarded as the Minister to whom each related law
refers by means of the statutory title set out in that law
and listed in the third column of the Schedule against
the consolidated area of responsibility in question; and
(b) assume the ministerial powers and duties assigned in
that respect by the related law.
(2) Where an entry in the second column of the Schedule
makes reference only to specific provisions or purposes of a related
law, the ministerial powers and duties corresponding to that entry
and assumed by the responsible Minister in terms of sub-article (1)
shall be limited to those deriving from the specified provisions or
purposes of the related law.

(a) more than one law bears the same name, except in so
far as the year of enactment may be concerned; and
(b) one or more such laws make reference to the same
statutory title,
the inclusion in the Schedule, with respect to that statutory title, of
a reference to any one such law or to such laws in the plural shall
be sufficient to enable the responsible Minister to assume, in terms
of sub-article (1), the powers and duties assigned by all such laws
with respect to that statutory title.
(4)
Where (a) a Minister has, by virtue of sub-article (1), been
assigned powers and duties pertaining to a statutory
title that is set out in an Act and is listed in the
Schedule; and
(b) a subsidiary law issued under that Act sets out or
makes reference to the same statutory title,
the Minister shall assume any powers and duties assigned by the
subsidiary law with respect to that statutory title, without the need
for the subsidiary law to be listed in the Schedule.
(5) Where more than one subsidiary law issued under the same
Act sets out a statutory title which is not mentioned in that Act, the
inclusion in the Schedule of one such subsidiary law with respect to
that statutory title shall be sufficient to enable the responsible
Minister to assume, in terms of sub-article (1), the powers and
duties assigned by all such subsidiary laws with respect to that
statutory title.
Amendments to the
Schedule.
4. (1) The Prime Minister may at any time, by Order in the
Gazette, amend or substitute the Schedule to this Act.
(2) An Order amending or substituting the Schedule may apply
retrospectively to any date which is so specified in the Order.
Publication of

5. (1) Whenever a Minister is assigned areas of responsibility
in accordance with article 82 of the Constitution, the Prime
Minister shall cause a notice listing those areas of responsibility to
be published in the Gazette.
(2) A notice published in accordance with sub-article (1) may,
in addition to areas of responsibility, list those departments,
agencies, and other entities that have been placed under the
Minister concerned; however the list of such departments, agencies
and other entities shall be regarded as indicative rather than
comprehensive.

6.
Nothing in this Act shall impede the application of the
Ministers (Delegation of Functions) Act.
