RATIFICATION OF TREATIES
(SAINT ANGELO) ACT
AN ACT authorising the Government to ratify the agreement between the
Government of Malta and the Government of the Sovereign Hospitalier
Order of Saint John of Jerusalem, of Rhodes and of Malta done in Malta on
the fifth December, 1998, and for matters consequent and ancillary thereto.

1.
The short title of this Act is Ratification of Treaties (Saint
Angelo) Act.
2.
In this Act unless the context otherwise requires:
Short title.
Interpretation.
"Agreement" means the agreement signed between the
Government of Malta and the Government of the Order, at the
P a l a c e , Va l l e t t a , M a l t a o n t h e 5 t h D e c e m b e r, 1 9 9 8 , w h i c h
agreement is reproduced in the original English and Italian texts
thereof (together with a Maltese translation) in the Schedule to this
Act;
"Order" means the Sovereign Hospitalier Order of Saint John of
Jerusalem, of Rhodes and of Malta;
"Saint Angelo" means the land and buildings forming part of Fort
Saint Angelo, Vittoriosa as shown delineated in green on the plan
contained in the Annex to the Agreement.

For the purposes of the Ratification of Treaties Act, the
Government is hereby authorised to ratify the Agreement.

4. (1) By virtue of this Act, and without the need of any
further formality other than this Act, the Government grants the
Order the right of use of Saint Angelo for the purposes and subject
to the conditions set out in the Agreement.

(2) Notwithstanding anything contained in the Civil Code or in
any other law, the right granted under subarticle (1) shall be for the
period of duration of the Agreement provided in Article 15 thereof.

5. (1) Saint Angelo shall enjoy all the privileges and
immunities as set out in, and subject to, the Agreement, and the
Order and the officers thereof referred to in the Agreement, and
their residences, shall enjoy therein all privileges and immunities
contained in and referred to in, and subject to, the Agreement, and
the Diplomatic Immunities and Privileges Act shall be read and
applied as if the privileges and immunities contained or referred to
in the Agreement were included in the said Act.

(2) Except as provided in the Agreement, the Courts and
Tribunals of Malta shall have full and exclusive jurisdiction at
Saint Angelo and Maltese law shall apply.

Act shall come into
force upon

RATIFICATION OF TREATIES (SAINT ANGELO)
6. (1) The provisions of this Act shall come into force upon
the exchange of instruments between the Government and the
Order ratifying the Agreement.
(2) The Minister responsible for foreign affairs shall by notice
in the Gazette notify the date of exchange of the ratification
instruments referred to in subarticle (1).

7.
The Schedule to this Act shall be published in the original
texts thereof together with a Maltese translation thereof and shall
be published only with the Maltese text of this Act.
In case of conflict regarding the aforesaid, the English text shall
prevail.
