Divorce in Cyprus: grounds, consensual divorce and the Family Court

A marriage in Cyprus, whether civil or religious, can be dissolved only by a judgment of the Family Court. Since the 2023 amendment of the Marriage Law of 2003 (Law 104(I)/2003), section 27 offers three main routes. First, a consensual divorce: the spouses, freely and jointly, ask the court to dissolve the marriage, at the earliest six months after the wedding, and confirm their consent in person before the court. Second, divorce after at least two years of separation, which proves an irretrievable breakdown. Third, divorce because relations have been seriously damaged for a reason relating to the other spouse, which is presumed in cases of bigamy, adultery, desertion, an attempt on the spouse's life or violence against the spouse or a child. If the couple has minor children, the consensual divorce is granted at the same hearing only if a court decision regulating the children's matters (parental care, residence, contact, maintenance) has been filed. Divorce itself does not decide the property of the spouses, spousal maintenance or the children's arrangements; these are separate applications before the same Family Court. This guide explains which ground to choose, what to file, how long it takes and which related claims you must not forget.

Deadline

Consensual divorce: the application can be filed at the earliest six months after the marriage. Separation ground: at least two years of separation; short attempts at reconciliation totalling no more than three months do not interrupt the period. Spousal maintenance after divorce for lack of suitable work or for retraining is limited to three years from the divorce (Law 232/1991, section 5).

The divorce becomes final only after the time for appeal has passed; the decision is then registered with the Civil Registry.

What to do

  1. Check that the Cypriot Family Court has jurisdiction. Family Courts established under the Family Courts Law of 1990 (Law 23/1990) hear divorce, parental care, maintenance and property disputes of spouses. For marriages of members of the Armenian, Maronite and Latin religious groups, the Family Courts (Religious Groups) Law of 1994 applies; for Turkish Cypriots, Cap. 339.

For spouses of different nationalities or living abroad, the EU Brussels IIb Regulation determines jurisdiction: usually the courts of the country where both spouses are, or were last, habitually resident and one still lives, or where the respondent resides. If both spouses are not Cypriot, take advice early: another country may also have jurisdiction.

  2. Choose the ground. If you both agree, a consensual divorce under section 27(1)(c) of Law 104(I)/2003 is the fastest and cheapest route. The application can be filed jointly or by one spouse, at least six months after the marriage, and both spouses declare their consent before the court.

If the other spouse does not agree, you need either two years of separation (section 27(1)(b)), or proof that relations have been seriously damaged for a reason relating to the other spouse (section 27(1)(a)). The Law presumes such damage in cases of bigamy, adultery, desertion, an attempt on your life, or violence against you or a child.

  3. Settle the children's arrangements first if they are minors. For a consensual divorce with minor children, the court will dissolve the marriage at the same hearing only if you file a copy of the court decision regulating the children's matters: parental care, the child's residence, contact with the other parent and maintenance.

You can apply to the Family Court for a consent order covering these issues, ideally after family mediation under Law 62(I)/2019. Without such a decision, the divorce is delayed. The best interests of the child are the guiding principle of the Parents and Children Relations Law of 1990.

  4. Prepare the documents. You will need the marriage certificate (certified, with translation into Greek if it was issued abroad), identity cards or passports, birth certificates of the children, evidence of residence in Cyprus and, for the separation ground, evidence of the date of separation (lease, utility bills, witness statements). For the fault ground, collect evidence of the facts relied on, such as police reports or medical certificates in cases of violence.

The application is filed at the Family Court of the district where you or your spouse live, with the prescribed court fee.

  5. Serve the application and attend the hearing. A contested divorce petition must be served on the other spouse, who can file a defence. The court may give directions, hear witnesses and then decide. In consensual cases, the hearing is short: the court checks the consent of both spouses and the children's arrangements.

If the other spouse cannot be found, ask the court for leave to serve by substituted means, for example by publication or electronically. A divorce granted without proper service can later be set aside.

  6. Claim spousal maintenance where necessary. During separation, a spouse can apply for maintenance under section 4 of Law 232/1991. After divorce, a former spouse who cannot support himself or herself may claim maintenance from the other, for example because of age or health, because he or she cares for a minor child, or because he or she cannot find suitable work or needs training; in the last case maintenance is limited to three years from the divorce.

Spousal maintenance orders also increase automatically by 10% every 24 months unless the court orders otherwise. Arrears under a maintenance order older than two years generally cannot be collected, so enforce promptly.

  7. Do not forget the property claim. Divorce does not divide property. Under section 14 of Law 232/1991, if the property of one spouse increased during the marriage and the other contributed in any way, including by caring for the home and children, the other spouse can sue for the share of the increase derived from his or her contribution, presumed to be one third.

The claim is filed separately before the Family Court. Gifts and inheritances are excluded from the increase. Take advice early: assets can be moved or encumbered while the divorce is pending.

  8. Register the divorce and update your documents. Once the divorce judgment is final, it is registered with the Civil Registry and Migration Department under the Marriage Law. Inform banks, employers, the Social Insurance Services and the tax department, and update your will and insurance beneficiaries.

A divorce granted by a Cypriot court is recognised in other EU countries without a special procedure under the Brussels IIb Regulation. For recognition in a non-EU country, ask for a certified copy and, if required, an apostille.

Frequently asked questions

9
How long does a divorce take in Cyprus?

A consensual divorce can be granted at a single hearing once the application is filed and, where there are minor children, a decision on their arrangements exists. A contested divorce can take one year or more, depending on the court's schedule and the evidence. Separate disputes about property and children can take longer.

Can I get a divorce in Cyprus if my spouse does not agree?

Yes. You can rely on at least two years of separation, or on serious damage to the marriage for a reason relating to your spouse, which is presumed in cases of bigamy, adultery, desertion, an attempt on your life or violence against you or a child (section 27 of Law 104(I)/2003).

Is there divorce by mutual consent in Cyprus?

Yes. Since the 2023 amendment, spouses can apply for consensual dissolution of the marriage, jointly or through one spouse, at least six months after the wedding. Both spouses declare their consent before the Family Court.

Do I need to go to the church before the Family Court?

No. Only the Family Court can dissolve a marriage with civil effect, including a religious marriage. Any church procedure is a separate religious matter and has no effect on the civil divorce.

How is property divided after divorce in Cyprus?

There is no automatic 50/50 split. Each spouse keeps his or her own property, but a spouse who contributed to the increase in the other's property during the marriage can claim the share deriving from that contribution, presumed to be one third, under section 14 of Law 232/1991.

Am I entitled to maintenance from my ex-spouse?

Possibly. Under section 5 of Law 232/1991, a former spouse who cannot support himself or herself may claim maintenance, for example because of age, health, caring for a child, or inability to find suitable work, the last limited to three years after the divorce.

Can foreigners get divorced in Cyprus?

Yes, if the Cypriot courts have jurisdiction, usually because the spouses are habitually resident in Cyprus. Under the Brussels IIb Regulation, jurisdiction depends mainly on habitual residence. Foreign marriage certificates must be certified and translated into Greek.

What happens to the children after divorce?

Parental care normally remains with both parents. The Family Court decides on residence, contact and maintenance according to the best interests of the child under Law 216/1990, preferably on the basis of an agreement between the parents.

Do I need a lawyer for a divorce in Cyprus?

It is strongly recommended, especially for contested cases and property claims. In a consensual divorce the procedure is simpler, but the documents must be correct and the children's arrangements must be settled by a court decision first.
